RESOLUTION NO. 2014-110
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING THE CONTRACT FOR CONSTRUCTION OF
ALGA NORTE COMMUNITY PARK PHASE 1, PROJECT NO. 3837A.
WHEREAS, the construction of the Alga Norte Community Park Phase 1 project was
substantially completed to the city's satisfaction by T.B. Penick & Sons, Inc. on

7 March 15, 2014; and
8 WHEREAS, the punchlist work was completed on May 27, 2014; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows that:
1. The above recitations are true and correct.
15 2. That the Alga Norte Community Park Phase 1, specifically identified as Project
16 No. 3837A is deemed complete and is hereby accepted by the City Council of the City of
Carlsbad.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
execute and record the Notice of Completion for the Alga Norte Community Park Phase 1,
21 Project No. 3837A.

PASSED, APPROVED AND ADOPTED at a Regular Meeting ofthe City Council ofthe City
of Carlsbad on the 3"^ day of June, 2014, by the following vote to wit:
