PS 13-110 4 AND DECLINING THE OFFER TO FABRICATE, INSTALL AND DONATE A COMMUNITY ARCHWAY SIGN TO THE CITY OF CARLSBAD. CASE NAME: CARLSBAD ARCHWAY SIGN CASE NO.: PS 13-110 7 The City Council ofthe City of Carlsbad, California, does hereby resolve as follows: 8 WHEREAS, pursuant to Title 11, Chapter 11.44^ B.3., way-finding signs ^ designed as archway signs located over major roads v/ithin the city may be allowed if approved by resolution of the City Council; and \\ \ \ WHEREAS, the applicant, ivtike Howes, on^btehalf ofthe Chamber of Commerce, submitted a sign perrr)it' applicatiipn on OctobVzS, 2013 for an archway sign to be located within the public right-of-way on Carlsbak^Boulevard, just north ofthe intersection of Carlsbad Village 10 11 12 13 14 15 Drive; and \ 16 \ \Al[HEREAS\TaylorMad4 Golf Company ("TaylorMade") has offered to donate fundi^to design, fl^bricate antkinst|Kthe sign; and 18 19 20 21 22 REAS, upon installation of the sign the Chamber of Commerce proposes to donate the si^ to the City of Carlsbad; and WH&REAS, since the sign was proposed to incorporate artwork proposed for donation to the public (the dolphin castings by Wyland, which has since been removed by the 23 applicant), the sign was subject to the Carlsbad Arts Commission review (Chapter 2.18 of the 24 Carlsbad Municipal Code); and 25 WHEREAS, On November 14, 2013, the Arts Commission's advisory panel voted unanimously to recommend to the Arts Commission that the artwork donation offer be declined; and y 8 9 10 11 12 1 „ WHEREAS, on December 5, 2013 the Arts Commission, after reviewing 2 ^ recommendations from its Arts Advisory Committee, voted 6-0 to reject the donation ofthe sign ^ as art work for the incorporation into the Art in Public Places Collections; and 5 WHEREAS, concurrent with the referral of the proposed sign to the Arts 6 Commission, planning staff conducted a review of the sign application; and ^ WHEREAS, the city has initiated a number of actions intended to revitalize and bring an identity, or branding, to the Village; and WHEREAS, the city has also recently initiated an effort to comprehensively update the Village Master Plan and Design Manual to spur renewal in the Village; and WHEREAS, a better opportunity now exists to explore support for, and consider 13 design of the community sign within the context of these broader 'placemaking' efforts getting 14 underway; doing so will give community members a chance to express their needs and desires 15 about the Village area in a holistic, structured fashion. NOW, THERFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That, on behalf of the City of Carlsbad, the City Council wishes to express 21 its appreciation to the Carlsbad Chamber of Commerce and TaylorMade Golf Company for their 22 generous offer of donation of the proposed Carlsbad Archway Sign. 2^ 3. That, for the reasons stated in the recitations above, the offer of donation is hereby declined, and that the sign application (PS 13-110) is hereby denied. /// /// 16 17 18 19 20 24 25 26 27 28 .2 7 'NOTICE TO APPLICANT" The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of 4 Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which 5 this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated cost or 6 preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one.
