HomeMy WebLinkAbout2014-07-08; City Council; Resolution 2014-1681 2 EXHIBIT 1 RESOLUTION NO. 2014-168 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BID AND AWARDING CONTRACT TO 4 FORMS+SURFACES FOR THE FABRICATION AND DELIVERY OF TRASH/RECYCLE RECEPTACLES AND BENCHES IN THE VILLAGE The City Council of the City of Carlsbad, California, does hereby resolve as follows: 7 WHEREAS, the City Council appropriated $1.4 million dollars in funds for the Fiscal 8 Year 2013-14 Downtown Area Capital Improvement Projects (Resolution No. 2013-146) for Village and Barrio revitalization projects; and WHEREAS, the appropriated funds include $290,000 for the Village streetscape improvements which include costs to purchase trash/recycle receptacles and benches; and WHEREAS, the Village streetscape improvements will provide a cohesive feel, a 9 10 11 12 13 sense of continuity and enhance the branding of the Village; and 15 WHEREAS, funds are available in the Fiscal Year 2013-14 Capital Improvement 16 Program budget for the trash/recycle receptacles and benches for the Village; and WHEREAS, requests for proposals were posted on May 1, 2014; and WHEREAS, four sealed bids were received, opened, witnessed and recorded in public by the city on June 3, 2014 for the trash/recycle receptacles and benches; and WHEREAS, a committee reviewed the bids following best value selection criteria; and 17 18 19 20 21 22 23 WHEREAS, it was determined that Forms+Surfaces is the best value 24 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 25 California, as follows: 26 That the above recitations are true and correct 27 28 7 8 9 10 11 12 16 19 20 21 23 24 25 26 27 28 2. Funds are available in the Fiscal Year 2013-14 Capital Improvement Program Budget for the trash/recycle receptacles and benches in the Village. 3. That the bids received and opened by the City for the trash/recycle 1 2 3 4 5 receptacles and benches in the Village on June 3, 2014 are hereby accepted and the best value 6 responsive, responsible bid is hereby determined to be that of Forms+Surfaces, in the amount of $229,908.90. 4. That the bid received from Forms+Surfaces is accepted, and that the contract is hereby awarded to Forms+Surfaces and that the Mayor is authorized to execute said contract on behalf of the city. "NOTICE TO APPLICANT" The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of 14 Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which 1^ this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated cost or preparation of such record, the time within which such petition may be filed in court is extended Yj to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one.
