HomeMy WebLinkAbout2014-07-08; City Council; Resolution 2014-1731 2 5 7 8 9 EXHIBIT 1 RESOLUTION NO. 2014-173 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SIGN PROGRAM PS 14-09 FOR THE 4 WESTFIELD CARLSBAD SPECIFIC PLAN GENERALLY LOCATED ON PROPERTY WEST OF EL CAMINO REAL AND BISECTED BY MARRON ROAD IN THE LOCAL FACILITIES MANAGEMENT ZONE 1. 5 CASE NAME: WESTFIELD CARLSBAD SIGN PROGRAM CASE NO.: PS 14-09 The City Council ofthe City of Carlsbad, California, does hereby resolve as follows: WHEREAS, City Council approved Resolution No. 2013-176 on July 9, 2013 certifying Final Environmental Impact Report for the Westfield Carlsbad Specific Plan/Site 11 Development Plan (EIR 09-02); and ^2 WHEREAS, City Council adopted Ordinance No. CS-219 on July 23, 2013 approving 13 14 15 16 17 City Planner; and 19 WHEREAS, the applicant, Westfield, LLC, submitted a Sign Program application on 20 January 23, 2014; and WHEREAS, staff reviewed the Sign Program and has found it to be consistent with all ofthe requirements and provisions ofthe Westfield Carlsbad Specific Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: the Westfield Carlsbad Specific Plan (SP 09-01); and WHEREAS, pursuant to the Westfield Carlsbad Specific Plan, a detailed Sign Program shall be prepared prior to the construction and/or installation of any new signs subject to initial approval by the City Council with any subsequent approvals to the satisfaction ofthe 21 22 23 24 25 25 1- That the above recitations are true and correct 27 2. That, no potentially significant impacts will result from implementation of 28 the Sign Program that were not previously evaluated in the Final EIR 09-02 1 2 3 4 7 8 11 12 13 15 16 17 18 19 20 21 23 24 25 26 27 28 3. That, for the reasons stated in the recitations above. Sign Program PS 14- 09 is hereby approved. "NOTICE TO APPLICANT" 5 The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of 6 Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated cost or preparation of such record, the time within which such petition may be filed in court is extended g to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one.
