HomeMy WebLinkAbout2014-07-22; City Council; Resolution 2014-180RESOLUTION NO. 2014-180 WHEREAS, on May 14, 2014 the City Manager of the City of Carlsbad proclaimed the existence of a local emergency due to conditions of extreme peril to the safety of persons and property caused by a wildfire in Carisbad; and WHEREAS, the City Council declared a local state of emergency on May 20, 2014, by Resolution No. 2014-104; and WHEREAS, on June 3, 2014, June 17, 2014, June 24, 2014 and July 8,2014 the City Council proclaimed the continuing existence of a local state of emergency by Resolution No's. 2014-115, 2014-126, 2014-157 and 2014-170; and WHEREAS, on June 10, 2014 the City Council designated and authorized agents to act on the behalf of the City of Carlsbad in the processing of disaster claims related to the 2014 Poinsettia Fire by Resolution No. 2014-121; and WHEREAS, on June 24, 2014 the City Councii authorized the Administrative Services Director to appropriate one million dollars ($1,000,000) from the General Fund to cover the cost of the expenditures related to the Poinsettia Fire as well as temporary repair work and/or clean up occurring within the first 30 days after the end of the incident with ended on May 17, 2014; and WHEREAS, state law requires the City Council review the need for continuing the 24 state of local emergency every 14 days pursuant to Public Contract code section 22050(c)(1) and 25 the Councii shall proclaim the termination of the local emergency at the earliest possible date that 2g the conditions warrant; and 27 WHEREAS, the Council has received the necessary information and update in 28 order to evaluate the continuing need for a local state of emergency; and 3 1 WHEREAS, staff has determined that all remaining contracts for recovery work 2 can be completed under the standard purchasing ordinance and in accordance with State law 3 there is no longer a need for the continued state of emergency under Public Contract code section 4 22050; and 5 WHEREAS, the City of Carlsbad has filed a notice of interest regarding applying 6 for federal and state disaster assistance in conjunction with the Declaration of Local Emergency 7 filed on May 20, 2014. 8 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 9 Carlsbad, California, as follows: 10 1. That the above recitations are true and correct. 11 2. The declaration of emergency is terminated according to State law. 12 3.
