HomeMy WebLinkAbout2014-07-22; City Council; Resolution 2014-195CITY COUNCIL RESOLUTION NO. 2014-195 1 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CAUFORNIA, APPROVING AN AMENDMENT TO THE VILLAGE 4 MASTER PLAN AND DESIGN MANUAL TO ALLOW WINERIES AS A PROVISIONAL USE IN DISTRICTS 5 AND 6 (OUTSIDE THE COASTAL ZONE) AND TO ADD SPECIAL PROVISIONAL USE STANDARDS FOR WINERIES TO THE PLAN FOR PROPERTY GENERALLY LOCATED IN THE CITY'S DOWNTOWN AREA AND ZONED "VILLAGE REVIEW" (V- 7 R) IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: VILLAGE MASTER PLAN CHANGES 8 CASE NO.: MP 12-01(B) 9 10 The City Council of the City of Carlsbad, California, does hereby resolve as follows: 11 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning 12 Commission did, on June 18, 2014, hold a duly noticed public hearing as prescribed by law to consider MP 12-01(B), the amendment to the Master Plan and Design Manual, as referenced in Planning Commission Resolution No. 7060; and WHEREAS, the Planning Commission adopted Planning Commission Resolution No. 7060 and recommended to the City Council approval of MP 12-01(B); and 13 14 15 16 17 WHEREAS, the City Council of the City of Carlsbad, on the 22nd day of _ 2014, held a duly noticed public hearing to consider the said amendment to 20 the Master Plan and Design Manual; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the City Council considered all factors relating to the Master Plan amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Carlsbad as follows: 28 2. That the recommendation of the Planning Commission for the approval of MP 12-01(B) is adopted and approved and that the findings of the Planning Commission contained in Planning Com mission Resolution No. 7060 on file with the City Clerk and 5 incorporated herein by reference are the findings of the City Council. 6 3. This action is final the date this resolution is adopted by the City Council. ^ The Provisions of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial g Review," shall apply: 9 "NOTICE TO APPLICANT" 10 The time within which judicial review ofthis decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropriate court not later than the ninetieth day following the date on 23 which this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated 14 cost or preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either 1^ personally delivered or mailed to the party, or his attorney of record, if he has one.
