2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING OF CONTRACT AND
ADDITIONAL $50,000 APPROPRIATION FOR BRIDGE RAILING
4 IMPROVEMENTS, LOCATED ON CARLSBAD BOULEVARD NORTH OF
MOUNTAIN VIEW DRIVE, PROJECT NOS. 3557, 6016.
WHEREAS, the City Council ofthe City ofCarlsbad, California, has determined it necessary,
desirable, and in the public interest to improve the bridge on Carlsbad Boulevard over the San
Diego North Railroad, north of Mountain View Drive; and
WHEREAS, on July 8, 2014, the City Council approved contract documents and
specifications for furnishing of all labor, materials, tools, equipment, transportation, and other
expenses necessary or incidental to the Bridge Railing Improvements, Project Nos. 3557 and
6016; and
WHEREAS, Three sealed bids were received on August 20, 2014 for the project; and
WHEREAS, the lowest responsive and responsible bid for the project was submitted by
Beador Construction Company, Inc.; and
WHEREAS, funding for said project has been appropriated from the Highway Bridge
Program, TransNet Local funds and Gas Tax; and
WHEREAS, additional appropriations from Gas Tax funds for said project are necessary.
19 NOW, THEREFORE, BE IT RESOLVED bythe CityCouncil ofthe City of Carlsbad, California,
20 as follows:
21 1. That the above recitations are true and correct.
22 2. That the bid submitted by Beador Construction Company, Inc. in the amount of
23 $636,300 is hereby accepted and the Mayor is hereby authorized to execute the contract for
24 bridge railing improvements and retaining wall rehabilitation. Project Nos. 3557 and 6016, in
2^ accordance with the specifications and contract documents referred to herein.
3. That the Administrative Services Director is hereby authorized to appropriate an

additional $50,000 from the Gas Tax Fund to Project No. 3557 for the retaining wall rehabilitation.

1 4. That the City Manager is hereby authorized to approve construction change orders
2 up to the contingency amount of $63,630 to Beador Construction Company, Inc. for bridge railing
3 improvements and retaining wall rehabilitation. Project Nos. 3557 and 6016.
4 5. That the award ofthis contract is contingent upon Beador Construction Company,
Inc. executing the required contract and submitting the required bonds and insurance policies,
as described in the contract, within twenty (20) calendar days of adoption of this resolution. The
City Manager may grant reasonable extensions of time.

of Carlsbad on the 23"'' day of September, 2014, by the following vote to wit:
