PROJECT NO. CT 01-09 5 WHEREAS, the Property Owner, Property Development Centers, LLC, a Delaware g limited liability corporation has executed a Reimbursement Agreement for the construction of 7 traffic signal at the intersection of La Costa Avenue and Camino de los Coches for La Costa Town 8 Square, Commercial (Agreement), and has submitted the Agreement to the City of Carlsbad for 9 .|Q approval; and 11 WHEREAS, the Property Owner has submitted this Agreement pursuant to ' condition 50 of Planning Commission Resolution No. 6581; and WHEREAS, staff recommends approval of this agreement in that it satisfies condition 50 of Planning Commission Resolution No. 6581. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 13 14 15 16 17 California, as follows: 18 1. That the above recitations are true and correct. 19 20 21 22 23 24 and the Mayor is authorized and directed to execute said Agreement. 25 3. That the City Clerk is authorized to forward said Agreement to the Office 26 ofthe County Recorder for recordation. 27 28 2. That the Reimbursement Agreement for the construction of traffic signal at the intersection of La Costa Avenue and Camino de los Coches for La Costa Town Square Commercial, Project No. CT 01-09 between Property Development Centers, LLC and the City of Carlsbad, which is attached hereto and incorporated herein by reference, is hereby approved 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PASSED, APPROVED AND ADOPTED at a Regular Meeting ofthe City Council ofthe City of Carlsbad on the 21st day of October 2014, by the following vote to wit: AYES: NOES: Council Members Hall, Packard, Schumacher, Blackburn.
