2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE APPROPRIATION OF FEDERAL
ASSET FORFEITURE FUNDS IN AN AMOUNT OF $55,682 TO
4 PURCHASE FIRE PERSONAL PROTECTIVE EQUIPMENT AND STOP
STICKS.

^ WHEREAS, police federal asset forfeiture funds are available for unbudgeted purchases

of needed police equipment; and

WHEREAS, the Poinsettia Fire demonstrated that police officers conducting emergency
9
evacuations, traffic control, and security during the fire were exposed to smoke, high heat, flying
11 embers and close contact with burning structures, and should be afforded the extra protection
12 of fire personal protective equipment; and

WHEREAS, stop sticks provide officers with an effective tool to end automobile pursuits
14
quickly and safely; and
15
WHEREAS, the Police Department needs to purchase both fire personal protective
16
equipment and Stock Sticks; and
18 WHEREAS, neither personal protective equipment nor stock sticks are budgeted via the
19 General Fund, so use of asset forfeiture funds is not supplanting and is allowed.

NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Carlsbad, California,

as follows that:

1. The above recitations are true and correct.

24 2. The cost of personal protective equipment is $42,578. The cost of stop sticks is
25 $13,104. Use of asset forfeiture funds is allowable (not supplanting), because neither
26 have been purchased via the General Fund.

1 3. The Administrative Services Director is authorized to appropriate police asset
2 forfeiture funds totaling $55,682 to purchase personal protective equipment and stop sticks.
