HomeMy WebLinkAbout2015-06-23; City Council; Resolution 2015-157EXHIBIT 1 1 RESOLUTION NO. 2015-157 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING THE AWARD OF A CONTRACT FOR CONSTRUCTION OF THE LIBRARY RENOVATION 4 PROJECTS, LOCATED AT 1775 DOVE LANE, PROJECT NO 4030 AND 1250 CARLSBAD VILLAGE DRIVE, PROJECT NO 4020. 5 6 7 WHEREAS, city facilities are necessary to meet the current and future Library & Cultural 8 Arts services within the City of Carlsbad; and WHEREAS Public Contract Code ("PCC") §20101 authorizes cities to pre-qualify 10 " 9 contractors who wish to bid on public works contracts; and authorizes staff to release invitations to 11 bid to the qualified contractors; and 12 j3 WHEREAS, city staff pre-qualified six contractors to submit bids for the Library Renovation 14 Projects in accordance with PCC §20101; and 15 WHEREAS, ON April 7, 2015, through Resolution No. 2015-090, the City Council ofthe City 16 of Carlsbad approved the plans and specifications for furnishing of all labor, materials, tools, 17 equipment, transportation, and other expenses necessary or incidental to Library Renovation 18 Projects, Project Nos. 4030 and 4020; and 20 WHEREAS, five sealed bids were received on May 28, 2015 by the City of Carlsbad for the 21 construction ofthe Library Renovation Projects, Project Nos. 4030 and 4020; and 22 WHEREAS, the lowest responsive and responsible bid for the project was submitted by 23 Prava Construction Services Inc. in the amount of $5,473,968; and 24 WHEREAS, The Augustine Company, the second lowest bidder, has alleged that Prava 25 Construction had failed to list the low voltage sub-contractor in the Designation of Subcontractors 26 27 Form; and 28 -2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, staff has investigated the claim and determined that the low voltage work will be performed by Prava's electrical subcontractor. Precision Electric, who was properly listed and has the required license to perform this work, and therefore, recommends the City Council deny the protest; and WHEREAS, funding for said project has previously been appropriated from the General Capital Construction and Infrastructure Replacement Funds in the amount of $6,310,000 to cover all contract costs including contingency and is sufficient; and WHEREAS, payment of prevailing wages will be required as part of the construction contract. NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. The bid protest from The Augustine Company is denied as Precision Electric was properly listed and has the required license to provide the low voltage work. 3. That the bid amount of $5,473,968 submitted by Prava Construction Services Inc. for the construction of the Library Renovation Projects, is accepted and the Mayor is hereby authorized to execute a contract with Prava Construction Services Inc. 4. That the City Manager is hereby authorized to approve construction change orders up to $710,000 (13 percent) for Projects 4030 and 4020. 5.
