HomeMy WebLinkAbout2015-11-03; City Council; Resolution 2015-269EXHIBIT 1 1 RESOLUTION NO. 2015-269 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE ESTABLISHMENT OF THE SEWER LATERAL GRANT PROGRAM AND APPROVING MODIFICATIONS TO 4 THE CITY OF CARLSBAD'S SANITARY SEWER MANAGEMENT PLAN 3 9 10 11 12 13 23 24 25 26 27 28 WHEREAS, on Aug. 7,2007, City Council adopted revisions to the Carlsbad Municipal Code 5 6 7 section 13.04.045 defining responsibilities for private lateral maintenance and cleaning; and 8 WHEREAS, Jul. 21, 2009, City Council adopted Resolution No. 2009-192 approving the City ofCarlsbad Sewer System Management Plan (SSMP); and WHEREAS, sanitary sewer spills threaten public health and adversely affect the environment; and WHEREAS, many ofthe reported sewer overflows are caused by deteriorated or damaged 14 sewer lateral piping; and 15 WHEREAS, Feb. 25, 2015, the City of Carlsbad settled litigation pertaining to sewer spills and is required to establish a Sewer Lateral Grant Program (Program); and 17 WHEREAS, the establishment ofthe Program will enable the city's Wastewater Division 18 to assist our sewer service area customers with repair, rehabilitation or replacement of their 19 2Q sewer laterals; and 21 WHEREAS, modifications to the SSMP will incorporate language regarding the 22 establishment ofthe program and its guidelines. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 3 1 2. That the Program is hereby established and funded as provided herein. The 2 Wastewater Division shall be charged with awarding grants through this program, provided sufficient funds are available. 3. That the Program shall be funded with $50,000 for half of Fiscal Year 2016 and then Fiscal Years 2017-21. Funding is budgeted in the Wastewater Operating Budget. Following 3 4 5 6 7 expenditure ofthe annual funds dedicated to this purpose, the program shall be suspended to 8 evaluate its validity and until such time as additional funds are appropriated to the program. ^ 4. That a Program report shall provide an accounting of the use of funds and 10 assistance in determining ifthe program should be continued. 11 5. Exhibit 2 j^0^A ^City of Carlsbad Utilities Sewer Lateral Grant Program Guidelines The City of Carlsbad Wastewater Division will assist property owners with replacement or rehabilitation of their private sewer lateral from the building to the sewer main in an effort to lower the number of sewer spills associated with faulty sewer pipelines. The sewer lateral is a pipeline that runs from the building to the sewer main generally located in the middle ofthe street. Spills from private sewer laterals account for a majority ofthe overflows reported to the State Water Board. The Carlsbad Wastewater Division is responsible to report every sewer spill including spills from private sewer laterals. The goal ofthis lateral grant program is to lower the amount of spills by assisting Carlsbad sewer customers with refurbishing the sewer lateral that are in most need of repair. This assistance is in the form of a grant program that will reimburse the property owner half (up to $3,000) ofthe expenses spent on these repairs. Repairs can be accomplished by either open trench cut method where the pipe is replaced or through trenchless techniques where the sewer pipe is lined and all of the work is done inside the pipe and there are a minimal number of trenches cut. The property owner is required to: • Fill out a questionnaire; and • Solicit three bids for the repair work; and • Submit the questionnaire and the bids to the Carlsbad Wastewater Division for approval. The bid winning licensed plumbing contractor will then apply for all appropriate City of Carlsbad Permits. All of the necessary permits and plans must be submitted before they are granted approval to start the work. A video of the sewer lateral after construction is required. The Carlsbad Wastewater Division representative and the property owner will review the video. The property owner will then release the City of Carlsbad from liability. The Sewer Lateral Grant Program will operate on a first come, first served basis. In the event there are several applications submitted at one time, there will be a triage survey done to decide a prioritization. The highest priority will be given to locations that have had overflows/spills. This Program is offered to sewer customers within the Carlsbad Wastewater service area which includes a majority ofthe City of Carlsbad except for the south and southeast portions ofthe city.
