RESOLUTION NO. 2016-082
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE PLANS AND SPECIFICATIONS, A
TEMPORARY RIGHT OF ENTRY AGREEMENT, APPROPRIATION OF
FUNDS IN THE AMOUNT OF $185,000, AND AUTHORIZATION TO
ADVERTISE FOR BIDS FOR THE AGUA HEDIONDA CREEK STORM
DRAIN OUTFALL AND STREAMBANK RESTORATION PROJECT,
PROJECT NO. 6618.
EXHIBIT 1
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable, and in the public interest to construct the Agua Hedionda Creek Storm
Drain Outfall and Streambank Restoration Project, Project No. 6618; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental to construct the Agua
Hedionda Creek Storm Drain Outfall and Streambank Restoration Project, Project No. 6618,
have been prepared and are on file in the Public Works Department of the City of Carlsbad and
are incorporated herein by reference; and
WHEREAS, an additional appropriation of $185,000 from the Infrastructure
Replacement Fund is requested to cover all project costs; and
WHEREAS, a Temporary Right of Entry Agreement with the property owner is necessary
to allow access to the project site.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California
as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications and contract documents for the Agua Hedionda
Creek Storm Drain Outfall and Streambank Restoration Project, Project No. 6618,

are on file in the Public Works Department of the City of Carlsbad and are hereby
approved.
3. That an additional appropriation of $185,000 from the Infrastructure
Replacement Fund is hereby approved.
4. That the City Manager is hereby authorized and directed to execute the
Temporary Right of Entry Agreement attached hereto as Attachment A.
5. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
publish, in accordance with State law, a Notice to Contractors Inviting Bids for the
Agua Hedionda Creek Storm Drain Outfall and Streambank Restoration Project,
Project No. 6618, in accordance with the plans, specifications, and contract
documents referred to herein.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City
of Carlsbad on the 3rd day of May, 2016, by the following vote to wit:
AYES: Hall, Wood, Schumacher, Blackburn, Packard.
NOES: None.
ABSENT: None.
