HomeMy WebLinkAbout2016-08-23; City Council; Resolution 2016-180RESOLUTION NO. 2016-180 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING COUNCIL TO SET A PUBLIC HEARING TO APPROVE PROPOSED NEW FEE STRUCTURE FOR FIRE PREVENTION SERVICES AND RELATED FEES TO SIMPLIFY EXISTING FEES AND ALIGN FEES WITH THE REASONABLE COSTS OF PROVIDING EACH SERVICE WHEREAS, the City Council of the City of Carlsbad, California has determined that the city is currently undergoing a major software implementation, Energov Permitting and Licensing, that will greatly increase the availability of development related information to the public. As part of the project, Community & Economic Development led a study to simplify the city's existing fees related to development; and WHEREAS, the preliminary review of the city's fees concluded that while there were opportunities for fire prevention to simplify fees, the city's fire fees warranted a comprehensive study. Having not been analyzed in a significant amount of time, the Fire Prevention Division pursued a comprehensive analysis to determine if their fees were aligned with industry best practices and are adequately recovering the city's costs to provide services; and WHEREAS, there were three primary phases of analysis applied throughout the Cost of Services (Fee) Study: Cost of Service Analysis, Cost Recovery Evaluation, and Fee Establishment; and WHEREAS, the study showed that on average the city is not recovering the total eligible cost of service for each fee category identified and studied. The city is currently recovering approximately 23% of the cost of providing services for which a fee could be charged; and WHEREAS, the fee study included a range of fee structure design and fee structure implementation considerations including: addition to and deletion of fee categories, revision to the structure of fees, and documentation of tools to calculate special cost recovery; and WHEREAS, the Fire Department recommends a 100% cost recovery model for fees associated with development and special events/activities. The Fire Department recommends a 0% fee model for fees associated with the inspections of buildings for the purposes of maintenance; and WHEREAS, at the August 23, 2016 meeting, city council received a report on the fee study for fire prevention and set a public hearing for the fire prevention fee changes on September 13, 2016. The effective date for the new rates is November 13, 2016, or the date the city goes live with the new permitting and licensing software, Energov, but no sooner than is allowed by Government Code Section 66016. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. City Council received a report on the fee study done for Fire Prevention and set a public hearing on September 13, 2016 to approve the proposed new fee structure for fire prevention services and related fees to simplify existing fees and align fees with the reasonable costs of providing each service. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 23.!:Q day of August, 2016, by the following vote, to wit: AYES: Hall, Wood, Schumacher, Blackburn, Packard.
