HomeMy WebLinkAbout2016-09-27; City Council; Resolution 2016-198RESOLUTION NO. 2016-198 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE 2015-2016 CONSOLIDATED ANNUAL PERFORMANCE AND EVALUATION REPORT FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND AUTHORIZING SUBMISSION OF THE REPORT TO THE US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT EXHIBIT 1 WHEREAS, the City of Carlsbad is a recipient of federal Community Development Block Grant Funds (CDBG) funds administered by the United States Department of Housing and Urban Development (HUD); and WHEREAS, a Consolidated Annual Performance and Evaluation Report is required by HUD for review of the city's performance in carrying out its Annual Strategy and in relationship to meeting the city's overall five year priorities and strategies for housing and community development; and WHEREAS, the City Council of the City of Carlsbad has considered the city's 2015-2016 Consolidated Annual Performance and Evaluation Report (Attachment A) for the CDBG Program and its submission to the US Department of HUD; and WHEREAS, the City Council has taken all public comment into account. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City of Carlsbad's 2015-2016 Consolidated Annual Performance and Evaluation Report for the Community Development Block Grant Program (Attached here to as Attachment A) is hereby approved for submission to the United States Department of Housing and Urban Development. 3. That the City of Carlsbad published the required notice in the local general circulation newspaper announcing a fifteen (15) day public review and comment period on the 2015-2016 Consolidated Annual Performance and Evaluation Report. The city received an annual CDBG allocation of $511,394 for the 2015-2016 program year. Approximately $322,898 in CDBG funds were expended during the 2015-2016 program year. The 2015-2016 year included receipt of a significant amount of Program Income, approximately $244,527, which had a direct impact on timeliness expenditure requirements from HUD. However, the city did move quickly to address the requirement and was able to quickly reallocate some funding to other eligible projects. With the assistance of Carlsbad CDBG program dollars, a total of 1,438 homeless or near homeless persons received temporary shelter, basic needs and services. A total of 103 Carlsbad seniors were assisted with emergency meal boxes and delivery of meals to their homes. CDBG funds were also utilized to begin ADA improvements in the Barrio Area of Carlsbad; these improvements are in coordination with the city approved ADA Transition Plan which will benefit all residents. This project is scheduled to conclude in September 2016. CDBG funds also provided funding to CSA San Diego to provide fair housing services to Carlsbad residents. In total, CSA San Diego was able to assist 105 Carlsbad households resolve their fair housing disputes. To further educate our region, the cities of Carlsbad, Oceanside, and Encinitas held a Rental Property Owners Seminar (Oceanside City Hall, 300 North Coast Highway, Oceanside, CA) and a Tenant Outreach Seminar (Carlsbad Senior Center, 799 Pine Avenue, Carlsbad, CA); both sessions were heavily attended by the property owners and residents in the region. The city actively participates in the Alliance for Regional Solutions, which is a regional winter shelter system serving homeless populations in Northern San Diego County. Carlsbad's 2015 contribution to the regional effort was $18,778; this amount represents the city's "fair-share" based on population of the support services (case management, night security, date and evaluation, etc.). The 2015 winter season represented the ninth season of this regional approach which focuses on transportation support for shelter residents, providing on-site psychiatric assessments, services targeting chronically homeless, and implementing further best practices on a region-wide basis. As in past years, the goal of the regional homeless shelter system is to provide homeless individuals and families in Northern San Diego County with not only a safe haven during the winter months, but to also provide the tools and motivation necessary to move them towards self-sufficiency and their maximum level of independent and responsivity functioning. As defined by the Carlsbad Consolidated Plan, the highest priorities for 2015-2019 are: • Increase the supply of affordable housing units • Provide supportive services for the homeless, lower-income residents, and persons with special needs • Improve and provide facilities to serve lower income persons • Provide fair housing services to residents • Planning and administration CAPER 5 0MB Control No: 2506-0117 (exp. 07/31/2015) Item #4 September 27, 2016 Page 9 of 72 During FY 2015-2016, Carlsbad expended approximately $83,523 in CDBG funds for Planning and Administration; approximately $71,171 was expended to activities related to support services for the homeless, lower income residents and persons with special needs; $15,000 was expended in the effort to provide fair housing services to residents. The city also invested $166,203 of CDBG grant funding towards improving and providing public facilities at the Casa de Amparo facility. In May of 2016, the city executed a CDBG substantial amendment for $169,000 to perform ADA improvements, in accordance with the city's ADA Transition Plan, in our Barrio Carlsbad Area. This public facilities improvement project is slated to be concluded by the end of September 2016. Because the city was unable to identify an eligible project to fund with CDBG monies, no additional affordable housing units were created with the assistance of this funding this year. However, the funds have been made available to housing service agencies who can assist with providing shelter and/or affordable housing opportunities. The city has funded or is proposing to fund additional affordable housing units with other funding sources, however, including administration of the Section 8 Rental Assistance program which disbursed $5,450,537 this reporting period and assisted an average of 545 families per month. According to the most recent data provided by American Community Survey, the city of Carlsbad is 85.1% white therefore it meets expectations with the highest population receiving assistance is white families. The HUD LA Fund of $50,818 reflects a repayment to HUD for a prior ineligible project; those funds were treated similar to Program Income received by the jurisdiction and drawn down for eligible reimbursements. Worthy of notation is the large sum of Program Income received, $244,527, by Carlsbad. As a result of the new accounting methods practiced, the city's CDBG program operated primarily off of Program Income and LA Fund for a majority of the year. CAPER 8 0MB Control No: 2506-0117 (exp. 07/31/2015) Item #4 September 27, 2016 Page 12 of 72 Leveraging Explain how federal funds leveraged additional resources (private, state and local funds), including a description of how matching requirements were satisfied, as well as how any publicly owned land or property located within the jurisdiction that were used to address the needs identified in the plan. In Carlsbad, the CDBG program does not have a matching requirement. The city's policy is to leverage, to the maximum extent feasible, the use of funds available in the development of affordable housing and the maintenance and preservation of existing housing throughout the entire city. The city continues to support thse use of CDBG and local Affordable Housing Trust funds for "gap financing" by private and non-profit entities in their efforts to develop affordable housing. All CDBG program funds are leveraged with outher sources of income, such as other federal, state, local and private funds. For organization that are allocated CDBG funds, these funds do not cover all of the organization's program costs and are leveraged with other sources to operate their programs. Any costs related to the administration of the CDBG program, in excess of the amount provided through the entitlement grant, are covered by the approved Housing & Neighborhood Services operational budget. The substantial amendment of $169,000 for ADA improvements in the Barrio Carlsbad Area utilized public property to allow for greater accessibility for all. CAPER 9 0MB Control No: 2506-0117 (exp. 07/31/2015) Item #4 September 27, 2016 Page 13 of 72 CR-20 -Affordable Housing 91.520{b) Evaluation of the jurisdiction's progress in providing affordable housing, including the number and types of families served, the number of extremely low-income, low-income, moderate- income, and middle-income persons.served. Carlsbad is a highly desirable place to live, work and play. The need for more affordable housing in Carlsbad for residents with low to moderate income is great and certainly far exceeds the plans for future development within the city limits. Throughout much of the region and country, household incomes have not kept pace with the rising cost of housing. Current market data provided by Zillow states that the median price of a home in Carlsbad is $744,200; on average homes have increased in value by 4.0% over the past year and prices are expected to increase incrementally in future years. During this time, the median price for a home in the County of San Diego hovered about $490,000. As a result of the citis lnclusionary Housing Ordinance, affordable housing development continues amidst the on slot of development in the community. The city continues to creatively strategize on ways to leverage CDBG funds mixed with a variety of different funding sources for future needs. The City of Carlsbad has the following resources for the creation and maintenance of affordable housing. lncfusionary Housing Ordinance-The City of Carlsbad has several programs which have been designed to increase affordable housing opportunities for lower income households. The signature program is Carlsbad's mandatory inclusionary housing program. This program requires housing developers to provide 15 percent of their total units as affordable to low income households. Since this requirement was set forth by ordinance in 1993, the city has experienced the successful construction of over 2,000 units of housing affordable to low, very low and extremely low income households; there are approximately 300 units currently pending final approval and construction within the next 1 to 2 years. HOME Program-The County of San Diego, lead agency for the HOME Consortium, offers a Down Payment and Assistance Program for low-income first-time homebuyers. The program provides simple interest loans, up to $70,000 to qualified households. The program has home value restrictions (currently $390,000), which is typically lower than market prices in Carlsbad making it a challenge for eligible homebuyers to locally find a home. However, eligible Carlsbad resident are encouraged to participate in this program but that may mean individuals might find it necessary to move outside of the Carlsbad city limits to find an appropriately priced home to CAPER 10 0MB Control No: 2506-0117 (exp. 07/31/2015) Item #4 September 27, 2016 Page 14 of 72 purchase. Due to limited CDBG resources, lack of direct HOME funding, and soaring land costs; the city was unable to produce any new affordable housing over this past year through the use of CDBG funds. Carlsbad continues to look to leverage funds and combine CDBG funding with local Housing Trust Fund money and/or other funds to produce future housing, acquisition, and rehabilitation projects. Discuss how these outcomes will impact future annual action plans. In future years, staff will remain vigilant of the possibilities to connect with possible developers and, if available, make CDBG funding available for eligible activities. Roughly 85 percent of residents assisted were in the extremely low-income category. As evidenced by this data, it is abundantly clear that there is continued need in our community. CAPER 12 0MB Control No: 2506-0117 {exp. 07/31/2015) Item #4 September 27, 2016 Page 16 of 72 CR-25 -Homeless and Other Special Needs 91.220{d, e); 91.320{d, e); 91.520{c) Evaluate the jurisdiction's progress in meeting its specific objectives for reducing and ending homelessness through: Reaching out to homeless persons (especially unsheltered persons) and assessing their individual needs For the past nine years, the City of Carlsbad has participated as an active member of the Alliance for Regional Solutions which focuses primarily on creating solutions for the Northern San Diego County homeless population and coordinates the winter shelters. During FY 2015-2016, the Carlsbad City Council awarded $18,778 from the General Fund to support the Regional Winter Shelter System. From a regional standpoint, this contribution supports services such as, but not limited to: transportation for shelter residents, providing on-site psychiatric assessments, services targeting chronically homeless, and implementing further best practices on a region- wide basis. Addressing the emergency shelter and transitional housing needs of homeless persons The City of Carlsbad does not have an emergency shelter rather Carlsbad is home to the permanent shelter operated by Catholic Charites called La Posada de Guadalupe (men's only shelter}. During FY 2015-2016, Catholic Charities was awarded $18,069 in CDBG funds to assist with programs at this shelter for short term (maximum of 60 days} housing and case management services. La Posada de Guadalupe is also transitional and seasonal housing for local farmworkers. Helping low-income individuals and families avoid becoming homeless, especially extremely low-income individuals and families and those who are: likely to become homeless after being discharged from publicly funded institutions and systems of care (such as health care facilities, mental health facilities, foster care and other youth facilities, and corrections programs and institutions); and, receiving assistance from public or private agencies that address housing, health, social services, employment, education, or youth needs. Helping homeless persons (especially chronically homeless individuals and families, families with children, veterans and their families, and unaccompanied youth) make the transition to permanent housing and independent living, including shortening the period of time that individuals and families experience homelessness, facilitating access for homeless individuals and families to affordable housing units, and preventing individuals and families who were recently homeless from becoming homeless again The City of Carlsbad does not directly receive HOME funding or Emergency Shelter Grant funding. CAPER 13 0MB Control No: 2506-0117 (exp. 07/31/2015) Item #4 September 27, 2016 Page 17 of 72 During FY 2015-2016, the City of Carlsbad awarded Community Resource Center $7,500 in CDBG funding to assist with programs to aid in the prevention and elimination of homelessness. The Community Resource Center's Homeless Prevention and Intervention Program includes case management, food assistance, employment preparation, motel vouchers, and emergency shelter support. This past year, the city also supported Brother Benno's via $8,784 in CDBG funding. Brother Benno's, operating in the neighboring jurisdiction of Oceanside, is a homeless service center which provides services to families such as case management, employment preparation, food assistance, emergency shelter support, furnishings for new homes, and clothing for families. Brother Benno's is a widely regarded service center in the region and assisted 50,290 individuals this past year. Carlsbad also benefitted Interfaith Community Services by way of CDBG funding in the amount of $4,000; those dollars were used to help with emergency rental assistance when otherwise they would have been left without shelter. Women's Resource Center, based out of Oceanside, is another public service agency which received CDBG funding ($10,569} to assist in their domestic violence shelter for families. This shelter is one of the few in the region that accepts families while providing case management and shelter for a maximum oftwo years. Residents of this shelter are encouraged to obtain jobs, further their education, and heal their family relationships during their stay. Lastly, through CDBG public service funding ($4,357) the YMCA of San Diego County was able to directly fund the Street Outreach Program. The target audience for this program is teens on the streets and helping to connect them with various service providers to aid in the prevention of homelessness. Actions taken to encourage public housing residents to become more involved in management and participate in homeownership This does not apply as the City of Carlsbad does not have Public Housing. CAPER 0MB Control No: 2506-0117 (exp. 07/31/2015) 15 Item #4 September 27, 2016 Page 19 of 72 CR-35 -Other Actions 91.2200)-(k); 91.320(i)-(j) Actions taken to remove or ameliorate the negative effects of public policies that serve as barriers to affordable housing such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges, growth limitations, and policies affecting the return on residential investment. 91.220 (j); 91.320 (i) Actions taken to address obstacles to meeting underserved needs. 91.220(k); 91.3200) The city participates in a regional Analysis of Impediments to Fair Housing Choice (Al). The impediments identified as part of the Al are obstacles the city must overcome to provide for its residents. The city has reported progress towards the impediments addressed in the FY 2015 Al in the attached Fair Housing Progress Report. Actions taken to reduce lead-based paint hazards. 91.220(k); 91.3200) HUD requires that all CDBG and HOME funded activities be in compliance with HU D's regulations regarding lead-based paint. In accordance with program requirements, the City of Carlsbad continues to provide all households receiving Section 8 Rental Assistance with information regarding the hazards of lead-based paint, treatment for lead poisoning, precautionary measures to avoid lead poisoning, precautionary measures to avoid lead poisoning and the advisability and availability of blood screening for lead poisoning. Informational brochures are available to the public in the Housing and Neighborhood Services Office at City Hall. Actions taken to reduce the number of poverty-level families. 91.220{k); 91.3200) The city assists in reducing the number of persons living below poverty level by providing funds to organizations that assist with job skill training and educational resources to assist in obtaining employment opportunities. The city also has implemented an economic development strategy for retention and attraction program; specifically designed to maintain current employers and corporate offices in Carlsbad as well as attract new companies to help our community flourish for years to come. Although funded with general funds rather than CDBG funds, the City operates a Hiring Center in Carlsbad to help persons obtain employment. Actions taken to develop institutional structure. 91.220{k); 91.3200) The CDBG program is managed and implemented by the Housing and Neighborhood Services Division within the Community and Economic Development Department. The Housing and Neighborhood Services Division is responsible for coordinating efforts with the San Diego HOME Consortium and monitoring of existing HOME programs. Housing and Neighborhood Services staff also oversees the Citizens' Advisory Committee which makes funding recommendations to the Carlsbad City Council for CDBG funding allocations. CAPER 16 0MB Control No: 2506-0117 (exp. 07/31/2015) Item #4 September 27, 2016 Page 20 of 72 Actions taken to enhance coordination between public and private housing and social service agencies. 91.220(k); 91.3200} Carlsbad CDBG and Housing staff collaborate daily and work together to participate in fair housing efforts each day. In partnership with the City of Oceanside and the City of Encinitas, our three jurisdicitons and associated Housing Authorities, held two public workshops this past year; one specifically with targeted information for landlords and property owners (held March 15, 2016 at the Oceanside City Hall) and the other was specifically developed for teants (held on April 25, 2016 at the Carlsbad Senior Center). The continued partnership with our three cities enables us to provide the best service to our residents along the northern coastal corridor of San Diego County. Regionally, the city participates in the County of San Diego HOME Consortium, which includes the County of San Diego and five other jurisdictions (Encinitas, San Marcos, Vista, Santee, and La Mesa). Members of the Consortium meet quarterly to discuss funding strategies and coordination of activities. However in light of the HOME ruling in 2013, the city no longer receives direct funding for HOME. The city continues to participate in the San Diego HOME Consortium which enables Carlsbad residents to utilize HOME programs administered and implemented by the County of San Diego. The city has actively committed to participating regionally and will continue to do so for the health of our program. The Al is a review of impediments or barriers that afftect the rights of fair housing choice. The report provides a demographic profile of the County, assesses housing needs specific to income groups, and evaluates housing opportunities available for all residents. The Al also analyzes both private market and public sector conditions that may limit or impede access to housing availabity for all segments of the population. While this report assesses the nature and extent of housing discrimination, it also focuses on developing solutions to mitigate such impediments. The 2015-2020 Al was completed on a regional level with participation from jurisdicitions throughout the County of San Diego with lead coordination through the San Diego Regional Allicance for Fair Housing (SDRAFFH). The Regional Alliance for Fair Housing is a coalition of fair housing organizaitons, community based groups, concerned citizens, representatives of the housing industry, and government agencies working toward the goal of affirmately furthering fair housing. Specifically, the City of Carlsbad commits to affimatively further fair housing by contracting for fair housing services annually with CSA San Diego and testing to determine the level of fair housing discrimination in Carlsbad. The fair housing services include outreach and education to residents, property managers, lenders, and housing developments, legal assistance or referrals, tenant/landlord mediation, and assistance with filing compiants to HUD. All federally funded programs are monitored on a regular basis to ensure compliance with all applicable federal reguations. Monitoring provides staff an opportunity to meet with our sub recipients and share any new federal guidance or regulations which benefit us all. Monitoring is directed toward the program goals, financial, and regulatory performances. Each subrecipient receiving CDBG dollars is monitored at least once every two years by Carlsbad staff. Furthermore, staff collects quarterly reports and invocies to ensure program goals are on target to ensure the timeliness of expenditures. Lastly, staff monitoring visits are done also to ensure that subrecipients comply with all regulations related to administrative, financial, and programmatic operations including Davis-Bacon prevailing wage regulations and to ensure their performance objectives and budget are on schedule. Citizen Participation Plan 91.lOS(d); 91.llS(d) Describe the efforts to provide citizens with reasonable notice and an opportunity to comment on performance reports. For the 2015-2016 CAPER, the city provided residents, stakeholders, and public service organizations with an opportunity to privde written comments during the 15-day comment period beginning September 9, 2016 to September 27, 2016. The public was notified of the public review and comment period through a publication in a local newspaper, available for download on the city's website (www.carlsbadca.gov), as well as two copies were made available to the public for review at the City Clerk's Office and at the Housing and Neighborhood Services Division both at Carlsbad City Hall (1200 Carlsbad Village Drive, Carlsbad, CA). The Carlsbad City Council is slated to approve the 2015-2016 CAPER at the public meeting held on September 27, 2016.
