HomeMy WebLinkAbout2016-12-13; City Council; Resolution 2016-250EXHIBIT 1 RESOLUTION NO. 2016-250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8,2016,DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS,a General Municipal Election was held and conducted in the City of Carlsbad, California, on Tuesday, November 8, 2016 as required by law; and, WHEREAS,notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California; and, WHEREAS,the City Council adopted Resolution No. 2016-111 on June 14, 2016 for the purpose of electing two Council Members for full terms of four years and submitting to the voters a question regarding the authorization to expend funds in excess of $1 million to construct a replacement Fire Station 2; and, WHEREAS the proposed Measure was known as Measure "0"on the November ballot and appeared as follows: Do the voters of the City of Carlsbad approve spending existing city funds from Yes various sources, including the General Fund,in an amount to exceed $1 million to construct a replacement Fire Station 2 located at the intersection of El Camino No Real and Arenal Road for an estimated cost range of $7 million up to $10.5 million? WHEREAS,the San Diego County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, and the results are received and attached hereto as Attachment A. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Carlsbad, California,as follows: 1.That the above recitations are true and correct. 2.That the whole number of ballots cast in the City of Carlsbad was 61,603. EXHIBIT 1 3.That the names of the persons voted for Members of the Carlsbad City Council at the General Municipal Election were as follows: Lorraine Wood Cori Schumacher Brandon Rowley Bill Fowler Ann Tanner Melanie Burkholder Keith Blackburn 4.That the City Council does declare and determine that Keith Blackburn and Cori Schumacher were elected as Members of the Carlsbad City Council for the full terms of four years. 5.That Measure "0"passed by a majority vote with 39,690 "Yes" votes and 16,130 "No" votes. 6.That the City Clerk's Office shall enter on the records of the City Council of the City of Carlsbad,a statement of the results of the election showing: (1) The whole number of ballots cast in the City (2) The names of the persons voted for (3) For what office each person was voted for (4) The number of votes given at each precinct to each candidate (5) The number of votes for and against the ballot proposition 7.That the City Clerk's Office shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the Oath of Office shall be administered as prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the City Clerk's Office.Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. 8.That the City Clerk shall certify to the passage and adoption of this Resolution. EXHIBIT 1 PASSED,APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 13th day of December, 2016, by the following vote, to wit: AYES:Hall, Wood, Schumacher, Blackburn, Packard.
