HomeMy WebLinkAbout2020-01-28; City Council; Resolution 2020-021RESOLUTION NO. 2020-021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS, WAIVING A MINOR IRREGULARITY IN SELECT ELECTRIC INC.'S BID, AWARDING A CONTRACT TO SELECT ELECTRIC INC. AND APPROPRIATING ADDITIONAL GAS TAX FUNDS FOR CONSTRUCTION OF THE TRAFFIC SIGNAL AT POINSETTIA LANE AND CASSIA ROAD AND THE TRAFFIC SIGNAL AT POINSETTIA LANE AND ORIOLE COURT/SKIMMER COURT, CAPITAL IMPROVEMENT PROGRAM PROJECT NOS. 6329 AND 6330. WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable and in the public interest to construct the traffic signal at Poinsettia Lane and Cassia Road, and the traffic signal at Poinsettia Lane and Oriole Court/Skimmer Court, Capital Improvement Program (CIP) Project Nos. 6329 and 6330 (Project); and WHEREAS, on Nov. 19, 2019, the City Council adopted Resolution No. 2019-239 approving plans and specifications and authorizing advertisement for bids for construction of the Project; and WHEREAS, six sealed bids were received on Dec. 17, 2019 for construction of the Project; and WHEREAS, Select Electric Inc. submitted the lowest responsive and responsible bid to construct the Project in an amount of $575,000; and WHEREAS, staff recommends that pursuant to Carlsbad Municipal Code Section 3.28.080(1)(3), the City Council waive a minor irregularity in the bid from Select Electric Inc. for not writing the total for bid item A-22, which does not confer a material advantage to Select Electric Inc.; and WHEREAS, staff has determined that additional Gas Tax Funds in the amount of $322,000 are necessary to complete construction of the Project; and WHEREAS, sufficient Gas Tax Funds are available to complete the Project; and WHEREAS, the Project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) -minor alteration of existing facilities including streets, sidewalks, gutters and similar facilities involving negligible or no expansion and not creating additional automobile lanes; and WHEREAS, Carlsbad Municipal Code Sections 3.28.040(C)(S) and 3.28.090(B) authorize the city manager to approve change orders in the amount up to the contingency set at the time of Project award. NOW; THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: Jan. 28, 2020 Item #4 Page 4 of 11 1. That the above recitations are true and correct. 2. That the minor irregularity in the bid submitted by Select Electric Inc. is hereby waived under Carlsbad Municipal Code Section 3.28.080(1)(3). 3. That the bid of $575,000 submitted by Select Electric Inc. for construction of the traffic signal at Poinsettia Lane and Cassia Road; and the traffic signal at Poinsettia Lane and Oriole Court/Skimmer Court, CIP Project Nos. 6329 and 6330, is accepted and the mayor is hereby authorized to execute a contract for the Project. 4. That the deputy city manager, administrative services, is authorized and directed to appropriate Gas Tax Funds in the amount of $322,000 to be split equally between CIP Project Nos. 6329 and 6330 for construction of the Project. 5. That the city manager or designee is hereby authorized to approve construction change orders up to the amount of $115,000. 6. That the award of this contract is contingent upon Select Electric Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this Resolution. The city manager may grant reasonable extensions of time. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 28th day of January 2020, by the following vote, to wit: AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
