HomeMy WebLinkAbout2020-02-25; City Council; Resolution 2020-037RESOLUTION NO. 2020-037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO ROBERTSON INDUSTRIES, INC., FOR THE AVIARA AND HIDDEN CANYON COMMUNITY PARK PLAYGROUND SAFETY RESURFACING PROJECT (CIP NO. 4745), IN AN AMOUNT NOT-TO-EXCEED $337,880. WHEREAS, the contract documents, plans, provisions, and specifications necessary to perform the replacement of the safety surfacing at the Aviara Community Park and Hidden Canyon Community Park playgrounds are on file in the city clerk's office, and are incorporated by reference herein; and WHEREAS, the existing safety surfacing at Aviara Community Park and Hidden Canyon Community Park is over 12 years old and is in need of replacement due to age and wear; and WHEREAS, the heavy use of these playgrounds over time has resulted in splits/tears, and a diminished overall quality of the safety surfacing; and WHEREAS, on Nov. 19, 2019, the City Council adopted a resolution approving the contract documents, plans, provisions and specifications, and authorizing the city clerk to advertise for bid the Aviara and Hidden Canyon Community Parks Playground Safety Resurfacing Project (Project); and WHEREAS, on Jan. 8, 2020 three bids for the Project were received and opened by staff; and WHEREAS, the engineer's estimate for the Project was $399,855; and WHEREAS, the apparent low bid, from Flexground Surfaces, was determined to be non- responsive due to its failure to acknowledge an addendum; and WHEREAS, not acknowledging the addendum would confer an unfair advantage to the bidder by providing the bidder the option to disregard that mate_rial amendment to the specifications; and WHEREAS, the next lowest bid, from Robertson Industries, Inc., was determined to be responsive, with a bid total of $337,879 and Feb. 25, 2020 Item #3 Page 4 of 5 WHEREAS, sufficient funds are available for the construction contract, construction administration, and Project contingency in the Capital Improvement Program Project Budget. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Mayor is hereby authorized and directed to execute a construction contract with Robertson Industries, Inc. for the Project, in an amount not-to-exceed $337,880. 3. That the city manager or designee is hereby authorized to approve construction change orders, singly or in aggregate, up to $33,790, for the Project. 4. That the award of this contract is contingent upon Robertson Industries, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 working days of adoption of this resolution. The city manager may grant reasonable extensions of time. 5. That the city clerk is authorized to return to the respective bidders all bid bonds. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 25th day of February 2020, by the following vote, to wit: AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
