HomeMy WebLinkAbout1983-04-13; Design Review Board; Resolution 0041 2 3 4 5 6 7 0 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 20 - DESIGN REVIEW B ARD RESOLUTION NO 004 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT TO ALLOW USE OF A TRAILER/MOBILE HOME AS A TEMPORARY COMMERCIAL OFFICE ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF STATE STREET, WEST OF BEECH AVENUE, IN THE AT & SF RAILROAD RIGHT-OF-WAY. APPLICANT: FRED HOWE GRADING, INC. CASE NO: RP/CUP 82-4 WHEREAS, a verified application has been filed with the 'ity of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request s provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, he Design Review Board did on the 13th day of April, 1983, hold . duly noticed public hearing to consider said application on lroperty described as: A parcel of the Atchison, Topeka, and Santa Fe Railroad right-of-way, Par. 2, S. B. E. 804-37-8-D, Map 1722. WHEREAS, at said public hearing, upon hearing and ronsidering all testimony and arguments, if any, of all persons lesiring to be heard, said Board considered all factors relating to :P/CUP 82-4. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review ioard of the City of Carlsbad as follows: L) That the foregoing recitations are true and correct. i) That based on the evidence presented at the public hearing, the Board DENIES RP/CUP 82-4 based on the following findings: 'indings: ) The project is not consistent with the goals and objectives of the Village Design Manual, as discussed in the Staff Report. I) The requested use is not necessary or desirable for the development of the downtown community, as discussed in the Staff Report. _. DRB RES0 NO. 004 4) Walls, fences and landscaping are not provided to adjust the requested use to existing or permitted future uses. 5) The project will not have a significant impact on the environment and, therefore, the Land Use Planning Manager has issued a Negative Declaration on December 9, 1982.
