HomeMy WebLinkAbout1983-05-11; Design Review Board; Resolution 0221 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 022 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A REDEVELOPMENT PERMIT TO REMODEL AND CONVERT AN EXISTING RESIDENCE TO A PSORIASIS TREATMENT CENTER ON THE WEST SIDE OF JEFFERSON STREET AT HOME STREET. APPLICANT: DR. FEINBERG CASE NO.: RP 83-6 WHEREAS, a verified application has been filed with the :ity of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request is provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, :he Design Review Board on the 11th day of May, 1983, held a duly ioticed public hearing to consider said application on property iescribed as: A portion of Lot 48 of Seaside Lands, according to Map thereof No. 1722, filed in the Office of the County Recorder on July 28, 1921. WHEREAS, at said public hearing, upon hearing and :onsidering all testimony and arguments, if any, of all persons lesiring to be heard, said Board considered all factors relating to 1P 83-6. NOM, THEREFORE, BE IT HEREBY RESOLVED by the Design Review ioard of the City of Carlsbad as follows: L) That the foregoing recitations are true and correct. !) That based on the evidence presetned at the public hearing, the Design Review Board recommends APPROVAL of RP 83-6, based on the following findings and subject to the following conditions: 'indings: ,) That the proposed project is consistent with the goals of the Village Design Manual, as discussed in the staff report. !) That the proposed project conforms to the requirements of the Zoning Ordinance, as discussed in the staff report. 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3) The applicant has agreed and is required by the inclusion of a appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enabl this body to find that public facilities will be available concurrent with need as required by the General Plan. 4) That the project is categorically exempt from environmental review per Section 19.04.070(9) of the Carlsbad Environmental Policies Ordinance and therefore the Land Use Planning Manager issued a Notice of Exemption on May 2, 1983. Conditions: Approval is granted for RP 83-6, as shown on Exhibit "A", dated May 2, 1983 and Exhibits 'IB" and 'IC", dated April 21, 1983, incorporated by reference and on file in the Land Use Planning office. Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewe facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by Cit Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated April 18, 1983, is on fil with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issuance. The applicant shall prepare a detailed landscape and irrigatio plan which shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. All landscaping and irrigation, per approved plan, shall be installed prior to occupancy of the building. All parking lot trees shall be a minimum of 15 gallons in size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. //// DRB RES0 NO. 022 2. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Any signs proposed for this development shall be designed in conformance with the city's Sign Ordinance and shall require review and approval of the Land Use Planning Manager prior to installation of such signs. The existing illegal sign shall be removed immediately and prior to installation of any additional signs. A uniform sign program for this development shall be submitted to the Land Use Planning Manager for his review and approval prior to occupancy of any building. Trash receptacle areas shall be enclosed by a 6-foot high masonry wall with gates pursuant to city standards. Location of said receptacles shall be approved by the Land Use Planning Manager. Parking spaces #1 and #2, as indicated on Exhibit A dated May 2, 1983, shall be enlarged to comply with minimum dimensions for full-size parking spaces. The driveway and parking lot shall be paved with a minimum of 2" of Asphaltic Concrete and striped. Said paving and striping shall be completed prior to occupancy of the building. The applicant shall construct a six foot high solid masonry wall along the side and rear property lines prior to occupancy of the building.
