HomeMy WebLinkAbout1985-08-14; Design Review Board; Resolution 0541 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 054 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A MINOR REDEVELOPMENT PERMIT TO ALLOW THE REMODEL OF AN EXISTING STRUCTURE ON PROPERTY GENERALLY LOCATED AT 1-5 AND ELM AVENUE. APPLICANT: TONY'S OF CARLSBAD CASE NO. : RP 85-14 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did on the 14th day of August, 1985, hold a public hearing to consider said application on property iiescribed as: Lot 29 inclusive in Block 66 of Town of Carlsbad, in the City of Carlsbad, County of San Diego, State of California according to the map thereof No. 535. WHEREAS, at said public hearing upon hearing and considering 311 testimony and arguments, if any, of all persons desiring to De heard, said Board considered all factors relating to RP 85-14. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review 3oard of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at a public hearing, the Board recommends APPROVAL of RP 85-14, based on the following findings: 'INDINGS: 1) The proposed project satisfies all the development standards and design criteria of the V-R (RP) Zone and the General Plan of the City of Carlsbad. 2) That the proposed project is compatible with the goals and policies of the Village Design Manual. * 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 20 ,- 3) That the project is compatible with the surrounding uses. CONDITIONS: 4) Approval is granted for RP 85-14 as shown on Exhibit 11 A 11 , dated August 1, 1985, incorporated by reference and on file in the Redevelopment Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 5) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at the time of Building Permit issuance. 6) Parking design shall include handicap spaces as required by codes in effect at the time Building Permits are issued. Redevelopment Office 7) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 8) Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Community Redevelopmen Manager prior to installation of such signs. 9) The freestanding sign located on the site must be removed within fifteen days of the approval of this Redevelopment Permit. PASSED, APPROVED AND ADOPTED at a regular meeting of the Design Review Board of the City of Carlsbad, California, held on this 14th day of August, 1985, by the following vote, to wit: AYES : Commissioners McCoy, Rombotis , Holmes Marcus and NOES : None Schlehuber .
