HomeMy WebLinkAbout1986-09-03; Design Review Board; Resolution 0821 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 082 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A MINOR REDEVELOPMENT PERMIT TO OPERATE A VIDEO TAPE RENTAL AND SALES STORE AT 325 OAK AVENUE. APPLICANT: THE VIDEO PLACE CASE NO. : RP 86-15 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 3rd day of September, 1986, consider said application on property described as: Lot 2 of Parcel Map 510 in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 11077. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented, the Board recommends APPROVAL of RP 86-15, based on the following findings and conditions .< Findings: 1) - The proposed project satisfies all the development Standards and design criteria of the V-R Zone and General Plan of the City of Carlsbad. 2) That the proposed project is compatible with the goals and policies of the Village Design Manual. 3) That the project is compatible with the surrounding uses. Conditions: Approval is granted for RP 86-15, as shown on Exhibits "Atf - "E" dated August 11, 1986, incorporated by reference and on file in the Redevelopment Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 1) , .- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2) This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated August 11, 1986 is on file with the City Clerk and incor- porated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 3) Approval of this request shall not excuse compliance with all sections of the zoning ordinance and all other City Ordinances in effect at time of building permit issuance. Planning : 4) - All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 5) Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Redevelopment Manager prior to installation. Engineering: 6) 7). Fire: 1) //// //// //// Prior to issuance of building permits or occupancy, the property owner/applicant shall record an irrevocable reciprocal access agreement for the adjacent property to the west. Plans, specifications, and supporting documents for all improvements shall be prepared to the satisfaction of the City Engineer. Prior to occupancy, the owner/developer shall install, or agree to install and secure with appro- priate security as provided by law the following improve- ments to City Standards to the satisfaction of the City Engineer: a). Full half street improvements of Oak Avenue along the frontage of the project and transitions off site. Prior to the issuance of building permits, complete build- ing plans shall be submitted to and approved by the Fire Department.
