HomeMy WebLinkAbout1988-02-17; Design Review Board; Resolution 1111 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 111 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARISBAD, CALIFORNIA, APPROVING A MINOR REDEVELOPMENT PERMIT TO INSTALL A MODULAR SINGLE FAMILY STRUCTURE TO REPLACE AN OLDER EXISTING RESIDENTIAL STRUCTURE ON PROPERTY GENERALLY LOCATED ON THE CORNER OF PINE AND ROOSEVELT (630 PINE) . APPLICANT: VALDEZ CASE NO: RP-87-13 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 17th day of February, 1988, hold a public hearing to consider said application on property described as: Lot 3 of Block 40 of Town of Carlsbad Amended Map No. 775. WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Board considered all factors relating to RP-87-13. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board of the City of Carlsbad as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing, the Board APPROVES RP-87-13, based on the following findings and subject to the following conditions: Findinss : 1. The project complies with the overall goals of Subarea 7 of the Village Design Manual and the development standards of the V-R Zone. 2. The site is physically suitable for the type and density of the development since the site is adequate in size 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and shape to accommodate residential development at the density proposed. a) The Desian Review Board has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and building cannot occur within the project unless sewer service remains available, and the Design Review Board is satisfied the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. b) All necessary public improvements have been provided or will be required as conditions of approval. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for residential development on the General Plan. This project is categorically exempt from CEQA, per Section 15303, class 3 (a). This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 1. Conditions: Mans 61 Exhibits 7) Approval is granted for RP 87-13, as shown on Exhibit(s) A 61 B, dated February 8, 1988, incorporated by reference and on file in the Redevelopment Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 8) The developer shall provide the City with a reproducible 24" x 36", 100 scale mylar copy of the (Site Plan) shall reflect the conditions of approval by the City. The (Plan) copy shall be submitted to the City Engineer prior to issuance of building permits or improvement plan submittal, whichever occurs first. Facilities &I Services 9) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 10) Water shall be provided to this project pursuant to the Water Service agreement between the City of Carlsbad and the Costa Real Water District, dated May 25, 1983. 11) This project shall comply with all conditions and mitigation required by the Zone 1 Local Facilities Management Plan approved by the City Council on September 1, 1987, incorporated herein and on file in the Redevelopment Office and any future amendments to the Plan made prior to the issuance of building permits. General Planning and Legal Conditions If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 13) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. 14) The structure shall be built in accordance with building code requirements for modular structures. SPecific Onsite Conditions 15) All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80- 6, to the satisfaction of the Directors of Planning and Building. 16) The existing garage does not meet standards for a 2-car garage. Therefore, one additional space must be shown on the site place. The site plan shall be revised and approved by the Housing and Redevelopment Director prior to issuance of a building permit. LandscaPe The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Housing and Redevelopment Director prior to the issuance of grading or building permits, whichever occurs first. Five-gallon shrubs shall be provided (instead of 1 gallon) next to the structure along Pine Avenue and along the west side of the building as shown on the site plan. 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 18) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Encrineerincr Conditions 19) This project may require a grading permit. The applicant shall conform to chapter 11.06 of the Carlsbad Municipal Code (Excavation and Grading). 20) Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer. 21) The site plan shall be revised to show a 24-foot backup area for the proposed parking spaces, to the satisfaction of the City Engineer. Fire Conditions 22) Prior to the issuance of building permits, complete building plans shall be submitted to an approved by the Fire Department.
