HomeMy WebLinkAbout1991-06-05; Design Review Board; Resolution 168- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 168 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA RECOMMENDING APPROVAL OF A COASTAL DEVELOPMENT PERMIT FOR THE PORTION OF THE PROJECT LOCATED WITHIN THE VILLAGE REDEVELOPMENT COASTAL AREA TO ALLOW THE CONSTRUCTION OF A 36" TO 48" SEWER INTERCEPTOR WITHIN THE CITY RIGHTS-OF-WAY ALONG JEFFERSON STREET, OAK AVENUE AND WITHIN THE AT&SF RAILROAD RIGHT-OF-WAY FROM OAK AVENUE TO THE SOUTHERN REDEVELOPMENT BOUNDARY. CASE NAME: VISTA/CARLSBAD SEWER INTERCEPTOR CASE NO.: CDP 90-3 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 5th day of June, 1991, hold a duly noticed public hearing to consider said application on property described above. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Design Review Board considered all factors relating to CDP 90-3. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Design Review Board hereby recommends APPROVAL of CDP 90-3, based on findings and subject to the following conditions: Findinns : 1. The project meets all the requirements of the Zoning Ordinance. 3. The proposed project will contribute to the economic revitalization of the Redevelopment Area. Conditions: 1. Approval is granted for QIP 90-3 as shown on Exhibits "A" - "R" dated May 15,1991, incorporated by reference and on file in the Redevelopment office. Development shall occur substantially as shown. 2. Approval of CDP 90-3 is granted subject to approval of RP 90-6. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Design Review Board of the City of Carlsbad, California, held on the 5th day of June, 1991 by the following vote, to wit: AYES: Chairman Schlehuber, Hall, Gonzales, Norby, Schramm.
