HomeMy WebLinkAbout1992-05-20; Design Review Board; Resolution 186- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 186 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA RECOMMENDING APPROVAL OF A COASTAL DEVELOPMENT PERMIT TO ALLOW THE CONSTRUCTION OF A 325 SQUARE FOOT PATIO ADDITION FOR OUTDOOR DINING ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF CARLSBAD BOULEVARD AND WALNUT AVENUE. CASE NAME: DINI’S BY-THE-SEA CASE NO: CDP 92-4 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 20th day of May, 1992, hold a duly noticed public hearing to consider said application on property described as: Lot 1 of Parcel Map No. 11340, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, September 26, 1985, WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Design Review Board considered all factors relating to CDP 92-4. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Design Review Board APPROVES of CDP 92-4 , based on the following findings and subject to the following conditions: ... The project is consistent with the goals, objectives, and development guidelines of the Village Design Manual by providing Commercial-TouriSt uses. 2. The project is consistent with the City's Local Coastal Program. 3. The project is consistent with all applicable City ordinances. Conditions: 1. Approval is granted for CDP 92-4, as shown on Exhibits "A" - "C", dated May 20, 1992, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Approval of CDP 92-4 is granted subject to approval of RP 84-ll(A). CDP 92-4 is subject to all conditions of RP 84-1 1 (A), Design Review Board Resolution No. 185, incorporated herein by reference and on file in the Planning Department. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Design Review Board of the City of Carlsbad, California, held on the 20th day of May, 1992 by the following vote, to wit: AYES: Chairperson Noble, Board Members: Gonzales, Rowlett, Erwin & Savary.
