HomeMy WebLinkAbout1992-12-02; Design Review Board; Resolution 1981 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 198 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA RECOMMENDING APPROVAL OF A REDEVELOPMENT PERMIT TO REPLACE A RETAIL BUILDING WITH A RESTAURANT AND RETAIL BUILDING AND ANCILLARY PARKING ON PROPERTY GENERALLY LOCATED ON THE 417 CARLSBAD VILLAGE DRIVE, CARLSBAD, CALIFORNIA. CASE NAME: FISH HOUSE VERA CRUZ CASENO: RP92-10 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 2nd day of December, 1992, hold a duly noticed public hearing to consider said application on property described as: Lot 1, Tract 10G of the City of Carlsbad, Map No. 1710, recorded in the office of the County of San Diego Recorder in December 1919. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Design Review Board considered all factors relating to RP 92-10. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as follows: A) B) That the foregoing recitations are true and correct. The proposed restaurant will enhance the commerual center hction of the downtown and enhance the street landscaping and is therefore consistent with the goals and objectives of the Village Design Manual. The project meets all the requirements of the Zoning Ordinance. The engineering analysis by City staff indicates that points of traffic conflict have been mitigated through onsite circulation design, median construction, and movement restrictions on the public street. The project proposes a restaurant in the downtown core commercial area, close to the beach. Several amenities such as the addition of street landscaping and removal of derelict buildings will occur as a result of this project. The proposal is therefore consistent with the General Plan. Conditions: 1. 2. 3. 4. 5. 6. Approval is granted for RP 92-10, as shown on Exhibit "A" - "E", dated December 2, 1992, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. Approval of RP 92-10 is granted subject to the approval of CDP 92-08. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. All landscape plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. Landscape plans shall be designed to minimize water use. Lawn and other zone 1 plants (see Landscape Manual) shall be limited to areas of special visual importance or high use. Mulches shall be used and irrigation equipment and design shall promote water conservation. The developer shall avoid trees that have invasive root systems, produce excessive litter and/or are too large relative to the lot size. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. All herbicides shall be applied by applicators licensed by the State of California. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. The first set of landscape and irrigation plans submitted shall include building plans, improvement plans and grading plans. The minimum shrub size shall be 5 gallons. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. As part of the plans submitted for building permit plan check, the applicant shall include a reduced version of the approving resolutiodresolutions on a 24" x 36" blueline drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal Development Permit and signed approved site plan. Detailed mechanical equipment and mechanical equipment plans shall be submitted for review and approval of the Planning Department prior to issuance of building permits. All mechanical equipment shall be screened. Signs shall be subject to approval of a separate City sign permit application prior to installation. Detailed exterior lighting plans (including fixtures) shall be submitted for the review and approval of the Planning Department prior to issuance of Building Permits. Parking for the building shall be provided in accordance with figures stated in the 21. Design Review staff Report dated December 2,1992. EnnineerinJE. - - conditions: 22. 23. 24. 25. 26. 27. Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell Telephone, and Cable TV authorities. The owner of the subject property shall execute a Hold Harmless Agreement regarding drainage across the adjacent property prior to approval of the building permit for this project. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the applicant shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The applicant shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. Prior to occupancy of the site as a restaurant/&h market the applicant shall install parking lot improvements and re-stripe the existing City leased parking lot on the railroad right-of-way property as shown on the site plan to the satisfaction of the city Engineer and the Planning Director. Fk Demartment: 28. Prior to issuance of building permits, complete building plans shall be approved by the Fire Department. Building Dem artment: 29. Working drawings shall be submitted, prior to issuance of building permits, which comply with the requirements of the Uniform Bddbg Code and Title 24 handicap person accessibility requirements. .... The entire potable water system, reclaimed water system, and sewer system shall be evaluated in detail to ensure that adequate capacity, pressure and flow demands are met. The Developer shall be responsible for all fees, deposits and charges which will be collected at time of issuance of the building permit. The San Diego County Water Authority capacity charge will be collected at issuance of application for meter installation. Sequentially, the Developeis Engineer shall do the following: k Meet with the City Fk Marshal and establish the fire protection requirements. B. Prepare a colored reclaimed water use area map and submit to the Planning Department for processing and approval. C. Schedule a meeting with the District Engineer for review, comment and approval of the pw-y system layout usage (G.P.M. - E.D.U.) plan for potable, reclaimed and sewer systems prior to the preparation of improvement plans. This project is approved upon the expressed condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water service and sewer facilities are available at the time of application for such water service and sewer permits will continue to be available until time of occupancy. This note shall be placed on the final map. The developer shall be responsiile for the installation of backflow prevention and sewer control requirements. Police DeDartment: 35. Lighting - Aisles, passageways, and recesses related to and within the building complex shall be illuminated with an intensity of at least twenty-five one hundredths (.25) footcandles at the ground level during the hours of darkness. Lighting devices shall be protected by and ~~-~kt~t COV~~S. 36. Open parking lots shall be provided with a maintained minimum of one (1) footcandle of light on the parking dace during the hours of darkness. Lighting devices shall be protected by weather and vandalism covm. Landscaping - The exterior landscaping should be kept at a minimal height and fdlness giving police, security services and the gend public surveillance capabilities of the area. It should also be designed so as to not provide coverage for someone trying to bide. Storage or dispod bins - should be located away from the area of any loading or receiving area. Disposal bins should be designed in a manner as to not provide coverage for someone trying to hide or sleep. Doors - Wood doors shall be of solid core construction with a minimum thickness of one and three fourths inches. Hollow steel doors shall have a minimum sixteen U.S. gauge and have sufficient reidorcement to maintain the designed thickness of the door when any locking device is installed. Glass doors shall have fully tempered glass or rated burglary resistant glazing. Auswingingexteriorwoodandsteeldoorsshallbeequippedwithsecurityhardware such as a dead bolt, reenforced strike plate and latch cover. Au double doors shall be equipped with an astragal constructed of steel a minimum of .125 inch thick which will cover the opening between the doors. The astragal shall be attached to the outside by means of welding or with non-removable bolts spaced apart on not more than ten inch centers. The inactive leaf shall be equipped with metal flush bolts having a minimum embedment of five-eighths inch into the head and threshold of the door fi-ame. The jamb on all aluminum frame Swinging doors shall be so constructed or protected to withstand 1600 pounds of pressure in both a vertical distance of three inches and horizontal distance of one inch each side of the strike, so as to prevent violation of the strike. Panic hardware shall be installed whenever it is required by the Uniform Building Code. Cashier - Special attention should be given to the cashier area. It should be placed to afford the cashier visibility of the entrances and exits with no signs or obstacles impeding surve!illance. The entrance and exits should be well defined and marked to avoid conflicts. Viewers - the door to the rear should be equipped with a viewer. The entrances should be given additional lighting during hours of darkness. AU exterior lights should be of the vandal resistant type.
