HomeMy WebLinkAbout1993-06-16; Design Review Board; Resolution 2051 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RESOLUTION NO. 205 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING AN AMENDMENT TO A MINOR REDEVELOPMENT PERMIT TO ALLOW THE EXPANSION OF AN FXISTING BAR ON PROPERTY GENERALLY LOCATED AT 421 AND 427 GRAND AVENUE. CASE NAME: THE ALLEY CASE NO: RP 85-01(B) WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 19th day of May, 1993, hold a duly noticed hearing to consider said application on property described as: Lot 15 and 16, Block "I", amended map of town of Carlsbad, County of San Diego, State of California, according to Map thereof No. 775 filed in the Office of the County Recorder of San Diego County, February 15,1894. WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Design Review Board considered all factors relating to RP 85-01(B). NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as follows: A) B) .... That the foregoing recitations are true and correct. That based on the evidence presented at the public hearing, the Design Review Board APPROVES RP 85-0l(B), based on the following findings: 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Findinest 1. The project is consistent with the uses, goals, and objectives of the Village Redevelopment Area since it is a commercial use which provides an attraction to the Village Center Special Treatment Area. 2. The project is consistent with the development standards and design guideline requirements of the Village Design Manual. The project is exempted from the off- street parking requirement because sufficient public parking exists outside the Coastal Zone and within a reasonable distance. 3. The project will not impact public parking located with the Coastal Zone. Conditions; 1. 2. 3. 4. 5. .... .... .... Approval is granted for RP 85-01(B), as shown on Exhibit "A", dated May 19, 1993, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. The project is subject to all conditions imposed by Design Review Board Resolution No. 204 approving RP 85-01(A) dated January 6, 1993, incorporated herein by reference. The annual review required by Condition No. 13 of Design Review Board Resolution No. 204 shall include a finding by the Housing and Redevelopment Director that sufficient off-street public parking exists to serve the project, or the project shall be returned to Design Review Board for review. The Design Review Board may revoke RP 85-01(B) if sufficient off-street parking does not exist. The 500 square foot expansion shall consist of an office and dance floor only with no additional tables located in the expanded area. Dancing is limited to the evening hours between 7:00pm and 2:OOam. BECKER, HOUSING AND REDEVELOPMENT DIRECTOR -3- DRB RES0 NO. 205
