HomeMy WebLinkAbout1993-06-16; Design Review Board; Resolution 2061 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN REVIEW BOARD RES0 LUTIO N NO, 206 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING AN REQUIREMENTS TO ALLOW AN AMENDMENT TO A MINOR REDEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED AT 421 AND 427 GRAND AVENUE. CASE NAME: THE ALLEY EXEMPTION FROM THE OFF-STREET PARKING CASE NO: RP 85-011B) WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 19th day of May, 1993, hold a duly noticed hearing to consider said application on property described as: Lot 15 and 16, Block *I*, amended map of town of Carlsbad, County of San Diego, State of California, according to Map thereof No. 775 filed in the Office of the County Recorder of San Diego County, February 15, 1894. WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Design Review Board considered all factors relating to Rp 85-01(B). NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as follows: A) B) That the foregoing recitations are true and correct. That based on the evidence presented at the public hearing, the Design Review Board APPROVES an exemption to the parking requirements for RP 85-01(B), based on the following findings, and subject to the following conditions: 1 2 3 4 5 6 7 E 9 IC 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. 2. 3. The lack of off-street parking to serve commercial establishments located in the Village Center Special Treatment Area constitutes an exceptional circumstance in which the application of the off-street parking provisions of the Carlsbad Municipal Code and Village Design Manual would result in practical difficulties or unnecessary hardships which would make development inconsistent with the general purpose and intent of the Carlsbad Village Redevelopment Plan. The granting of an exemption will not be injurious or materially detrimental to the public welfare or other properties in the area since sufficient public parking exists within a reasonable distance to adequately serve the project. The granting of a parking exemption will not contradict the standards established in the Village Design Manual since the proposed use will occupy an existing facility and is consistent with uses permitted in Sub-area 1 of the Village Design Manual. Compliance with the off-street parking standard is satisfied since sufficient public parking exists outside the Coastal Zone and within a reasonable distance of the use to satisfy the off- street parking requirement. The seven space parking exemption is subject to all conditions imposed by Design Review board Resolution No. 204 and Design Review Board Resolution No. 205 approving RP 85-01(A) and RP 85-01(B) allowing a 500 square foot expansion of the project. Approval of the parking exemption shall expire concurrent with RP 85-O1(B) unless extended as required by Condition No. 13 of Design Review Board Resolution No. 204.
