HomeMy WebLinkAbout1994-03-02; Design Review Board; Resolution 2111 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 DESIGN RENEW BOARD RESOLUTION NO. 211 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A COASTAL DEVELOPMENT PERMIT TO ALLOW A 1.64 ACRE LUMBER YARD ON PROPERTY GENERALLY LOCATED IN THE RAILROAD RIGHT-OF-WAY WEST OF STATE STREET AND SOUTHEAST OF CARLSBAD BOULEVARD IN SUB-AREA 3 OF THE VILLAGE REDEVELOPMENT ZONE. CASE NAME: BAUER LUMBER YARD RELOCATION CASE NO: CDP 94-01 WHEREAS, a verified application has been fled with the City of Carlsbad and referred to the Design Review Board; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Design Review Board did, on the 2nd day of March, 1994, hold a duly noticed hearing to consider said application on property described as: Portion of Parcel 17 of S.B.E. Map No. 804-37-8K, in the City of Carlsbad, County of San Diego, State of California. WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Design Review Board considered all factors relating to CDP 94-01. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Design Review Board APPROVES CDP 94-C1, based on the following findings and subject to the following conditions: 1. The proposed lumber yard is consistent with the various goals and objectives of the General Plan as evidenced by the provision of a regional service use, adequate landscaping, parking and site design. 1 2 3 4 5 6 7 e 9 1c 11 12 12 14 15 1E 17 1E 1s 2c 21 22 22 24 25 26 27 2e 2. The proposed lumber yard is in accordance with the Carlsbad Village Area Redevelopment Plan and Village egn Manual because! it improves the visual aesthetics of the area, and provides adequate building scale, landscaping, parking and signage. 3. The proposed lumber yard is in accordance with the applicable provisions of the Carlsbad Municipal Code as demonstrated by the maintenance of compatibilitywith surrounding uses, and the provision of parking, landscaping and appropriate signage- Conditions: 1. Approval is granted for CDP 94-01, as shown on Exhibits "A" - "B", dated March 2, 1994, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. Approval of CDP 94-01 is subject to approval of RP 94-01. All conditions of RP 94- 01 as contained in Design Review Board Resolution No. 210, dated March 2,1994, on file in the Planning Department, are incorporated herein by reference. 3. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance, the Vdlage Design Manual, and all other applicable City ordinances in effect at time of building permit issuance. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Design Review Board of the City of Carlsbad, California, held on the 2nd day of March, 1994 by the following vote, to wit: AYES: Chairperson Savary, Board Members: Noble & Rowlett.
