DESIGN REVIEW BOARD RESOLUTION NO. 223 A RESOLUTION OF THE DESIGN REVIEW BOARD OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A NEGATIVE DECLARATION FOR A MAJOR REDEVELOPMENT PERMIT TO EXTEND THE TERM FOR THE WEEKLY FARMER’S MARKET AND TO ALLOW FOR TWO LOCATED WITHIN THE VILLAGE. CASE NAME: FARMER’S MARKET APN RP 94-5 NON-CERTIFIED, NON-PRODUCE BOOTHS AT THE MARKET WHEREAS, the Design Review Board did on the 19th day of April, 1995 hold a duly noticed public hearing as prescribed by law to consider said request for a Negative Declaration; and, WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, examining the initial study, analyzing the information submitted by staff, and considering any written comments received, the Design Review Board considered all factors relating to the Negative Declaration. NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Design Review Board as follows: A. That the foregoing recitations are true and correct. B. That based on the evidence presented at the public hearing, the Design Review Board hereby APPROVES the Negative Declaration according to the one page notice and the EIA Part I1 Form attached hereto and made a part hereof, based on the following findings: 1. The Design Review Board of the City of Carlsbad has reviewed, analyzed and considered Negative Declaration (RP 94-05), the environmental impacts therein identified for this project and any comments thereon prior to approving the project. The Design Review Board finds that the Negative Declaration (RP 94-05) reflects the independent judgment of the Design Review Board of the City of Carlsbad. 3. The Record of Proceedings for this project consists of the initial study, EIA Part 11, and Negative Declaration, which may be found at the City of Carlsbad Community Development Building, 2075 Las Palmas Drive, Carlsbad, California in the custody of the City Clerk, Director of Planning. PASSED, APPROVED AND ADOPTED at a regular meeting of the Design Review Board of the City of Carlsbad, California, held on the 19th day of April, 1995, by the following vote, to wit: AYES: Noble, Welshons, Savary, Vessey NOES: None ABSENT: Marquez ABSTAIN None / ATTEST: &, KG EVAN E.
