CARLSBAD BOULEVARD AT PINE AVENUE IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: SCULPTURE PARK DEMOLITION RP/CDP 98-55 ON PROPERTY GENERALLY LOCATED WEST OF CASE NO.: FW/CDP 98-55 WHEREAS, the City of Carlsbad, “Developer”, has filed a verified application with the City of Carlsbad and it has been referred to the Design Review Board regarding property owned by the City of Carlsbad, “Owner”, described as A portion of the public right-of-way west of Carlsbad Boulevard at Pine Avenue (“the Property”); and WHEREAS, said verified application constitutes a request for a Minor Redevelopment/Coastal Development Permit as shown on Exhibits “A” thru “D” dated October 8, 1998, on file in the Housing and Redevelopment Department, SCULPTURE PARK DEMOLITION, RP/CDP 98-55 as provided by Chapter 21.35.080 and Chapter 21.201.040 of the Carlsbad Municipal Code; and WHEREAS, the Design Review Board did, on the 8th day of October 1998, hold a duly noticed special public hearing as prescribed by law to consider said request; and WHEREAS, at said special public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Board considered all factors relating to the CDP. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Board APPROVES SCULPTURE PARK DEMOLITION, RP/CDP 98-55, based on the following findings and subject to the following conditions: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Findiws: 1. 2. 3. 4. ... ... ... ... ... ... ... ... ... ... ... ... ... ... That the proposed development is in conformance with the Village Master Plan and Design Manual and Carlsbad Village Redevelopment Plan, which serve as the Certified Local Coastal Program for the City of Carlsbad’s Village Segment of the California Coastal Zone and all applicable policies in that the development is redevelopment of a public space on a previously improved lot, the development does not obstruct views or otherwise damage the visual beauty of the coastal zone and no agricultural activities, sensitive resources, geological instability exist on the site. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.03 of the Zoning Ordinance) in that the project will adhere to the City’s Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion, no steep slopes or native vegetation is located on the subject property and the site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. The proposal is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act in that the replacement improvements will not alter physical or visual access to the shore. The project is categorically exempt from environmental review per CEQA guidelines Section 1 5 3 0 1 ( 1)(4). DIU3 RESO. Staff is authorized and directed to make, or require Developer to make, all corrections and modifications to the document(s) necessary to make them internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Any proposed development different from this approval shall require an amendment to this approval. PASSED, APPROVED AND ADOPTED at a special meeting of the Design Review Board of the City of Carlsbad, California, held on the 8th day of October 1998, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: Chairperson Bill Compas.
