3 OF CARLSBAD, CALIFORNIA, RECOMMENDING ADOPTION OF A
NEGATIVE DECLARATION FOR A MAJOR REDEVELOPMENT
4 PERMIT NUMBER RP 05-04 FOR FUTURE REDEVELOPMENT OF
THE ARMY AND NAVY ACADEMY ON PROPERTY GENERALLY
LOCATED ON THE EAST AND WEST SIDE OF CARLSBAD
6 BOULEVARD BETWEEN MOUNTAIN VIEW DRIVE AND BEECH
AVENUE.

WHEREAS, Army and Navy Academy, "Applicant," has filed a verified application
, 2 with the City of Carlsbad regarding property owned by Army and Navy Academy, "Owner",
13 described as Assessor Parcel Numbers 203-14-206, 203-05-103, 203-05-201, 203-05-202, 203-
14 05-301,203-04-102 and more thoroughly described in Attachment A, ("the Property"); and
WHEREAS, a Negative Declaration was prepared in conjunction with said project; and
16 thWHEREAS, the Design Review Board did on the 5 day of November, 2008, hold a
17
duly noticed public hearing as prescribed by law to consider said request; and18
19 WHEREAS, at said public hearing, upon hearing and considering all testimony and
20 arguments, examining the initial study, analyzing the information submitted by staff, and
21 considering any written comments received, the Design Review Board considered all factors
22 relating to the Negative Declaration.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board as
24
follows:25
26 A) That the foregoing are true and correct.
27 B) That based on the evidence presented at the public hearing, the Design Review Board
hereby RECOMMENDS ADOPTION of the Negative Declaration, Exhibit "ND,"
28
according to Exhibits "NOI", and "Environmental Impact Assessment Form - Initial
2 Study (EIA)," attached hereto and made a part hereof, based on the following findings:
3 Findings;
1. The Design Review Board of the City of Carlsbad does hereby find:
a. it has reviewed, analyzed, and considered the Negative Declaration for Army and
6 Navy Academy Master Plan, analyzing the environmental impacts therein
identified for this project and any comments theron prior to RECOMMENDING
7 APPROVAL of the project: and

b. the Negative Declaration has been prepared in accordance with requirements of
9 the California Environmental Quality Act, the State Guidelines and the
Environmental Protection Procedures of the City of Carlsbad; and
10
c. it reflects the independent judgment of the Design Review Board of the City of
11 Carlsbad; and
12 d. based on the EIA Part II and comments theron, there is no substantial evidence the
13 project will have a significant effect on the environment.
