HomeMy WebLinkAbout1986-02-18; Housing & Redevelopment Commission; Resolution 621 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 RESOLUTION NO. 062 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA TO AMEND THE VILLAGE DESIGN MANUAL. WHEREAS, on June 14, 1985 the California Coastal Commission certified the City of Carlsbad Village Redevelc Area Segment Local Coastal Program Land Use Plan consistir the City of Carlsbad Village Area Redevelopment Plan and t Village Design Manual; and WHEREAS, on June 14, 1985 the California Coastal Commission conditionally certified the implementing ordin; for the land use plan on the condition that certain modifj to the Village Design Manual made by the City of Carlsbad; WHEREAS, the Housing and Redevelopment Commissior desires to amend the Village Design Manual to satisfy the conditions imposed by the California Coastal Commission, NOW, THEREFORE, the Housing and Redevelopment COI of the City of Carlsbad resolves as follows: 1. That the foregoing recitations are true and I 2. That the Village Design Manual adopted by Hol and Redevelopment Commission Resolution No. 14 is amended follows: a. Section VI1 is amended by the addition o following paragraph: "Restrictions on Amendments and Exemptions f Areas Within the Coastal Zone. For those portions of the Redevelopment Area which are within the coastal zone amen to the development guidelines, standards or criteria esta by this design manual shall not be effective until the am has been certified by the Coastal Commission or by its ex director pursuant to Coastal Commission regulation. Section XI1 is amended by the amendment 1 regulations for sub-area 1 to amend the last paragraph of 8 "Land Use" regulations to read as follows: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "Unless otherwise stated in this specific SUI density allocations may be increased beyond those ranges in the General Plan if the Housing and Redevelopment Comm finds that such an increase is consistent with the goals objectives of the Redevelopment Plan and further, providec within the coastal zone any increase in density allocatiol be approved by the Coastal Commission or its executive di. as an amendment to the Local Coastal Program." d. Section XI1 is amended by the amendment I regulations for sub-area 5 by amendment of the final para1 in the "Land Use" regulations to read as follows: "This sub-area is located within the coastal Developments entirely devoted to visiter commercial uses preferred in this sub-area. The entire ground floor of a projects shall be devoted to visitor commercial uses. Mi: projects which do not meet this criteria including but no: limited to time share projects, shall require approval by Coastal Commission or its executive director as an amendmc the Local Coastal Program. Unless otherwise stated in th. specific sub-area, residential density allocations may be increased beyond those ranges provided in the General Pla~ Housing and Redevelopment Commission finds that such an il is consistent with the goals and objectives of the Redeve: Plan and further, provided that such increases are approvc the Coastal Commission or its executive director as an amc to the Local Coastal Program." e. Section XI1 is amended by the amendment I regulations for sub-area 6 by the addition of the followi~ paragraph to the "Design" regulations: "Development of properties bordering Buena V Lagoon shall be designed to maintain in open space by the recordation of open space easements those portions of the area containing slopes in excess of 25% grade. For bluff areas with less . grade a wetland buffer area of not less than 100 feet in 1 shall be provided through the dedication of an appropriatc space easement to the appropriate state agency. In addit appropriate public access trail shall be provided along t: southern shoreline of Buena Vista Lagoon to facilitate pul awareness of the natural habitat resources of the Lagoon 1 that the appropriate state agency accepts the dedication c public access easement." 3. These amendments shall become effective upon certification by the executive director of the California Commission.
