RESOLUTION NO. 209 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A NEGATIVE DECLARATION AND A REDEVELOPMENT PERMIT (RP 91-4) TO ALLOW THE CONSTRUCTION OF A GAS STATION AND MINI-MART ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF CARLSBAD VILLAGE DRIVE AND HARDING STR APPLICANT: ARC0 AM/PM MINI-MART CASE NO: RP 91-4 WHEREAS, on April 1, 1992 the Carlsbad Design Board held a duly noticed public hearing to consider a g Negative Declaration and a Redevelopment Permit (RP-91-4) construction of a gas station and minimart and adopted Review Board Resolutions No. 179 and 180 respectively, recon to the Housing and Redevelopment Commission that the r; Declaration and Redevelopment Permit (RP-91-4) be approved WHEREAS, the Housing and Redevelopment Commissioi City of Carlsbad, on May 19, 1992 held a public hearing to c the recommendations and heard all persons interested in or to RP 91-4; and WHEREAS, a Negative Declaration was issued on Jal 1992 and submitted to the State Clearinghouse for a 30 dal period. All comments received from that review period ar incorporated into the conditions of approval for the redevr permit. These conditions will be reviewed through a mor program set up for the project. NOW, THEREFORE, BE IT RESOLVED by the Hous Redevelopment Commission of the City of Carlsbad, Califor follows: 1. That the above recitations are true and cor] 2. That Redevelopment Permit RP 91-4 is apprc that the findings and conditions of the Design Revie contained in Resolution No. 180 on file with the City C: incorporated herein by reference are the findings and condi the Housing and Redevelopment Commission with the excel Condition No. 17 to read as follows: "Traffic flow within the property must be managed by applicant in such a manner to minimize the impact Harding Street and Carlsbad Village Drive. The Des Review Board may review the applicant's compliance w this condition upon notice at a public hearing at time the Design Review Board deems review necessary it may recommend changes to the Housing and Redevelopm Commission. It 4. This action is final the date this resol, adopted by the City Council. The provision of Chapter 1.1 Carlsbad Municipal Code, "Time Limits for Judicial Revie apply: "NOTICE TO APPLICANT" "The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final: however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than I 1 the thirtieth day following the date on which mailed to the party, or his attorney of record, if he has one.
