HomeMy WebLinkAbout1992-11-30; Housing & Redevelopment Commission; Resolution 218.p, -I e a 1 2 3 4 5 6 7 8 9 x0 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 218 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA FINDING AND DETERMINING THAT THE USE OF MONIES FROM THE LOW AND MODERATE INCOME HOUSING FUND OUTSIDE TEE PROJECT AREA WILL BENEFIT THE PROJ: AREA AND AUTHORIZING THE EXPENDITURE OF SUCH F' WHEREAS, the Redevelopment Agency of the City of Carlsbad, hereinafter referred to as llAgencytl, is a Community Redevelopment Agency organized and existing un the Community Redevelopment Law, Health and Safetv Code Section 33000, et seq., hereinafter referred to as the ''ActV1 ; and WHEREAS, the Agency is authorized to implement the Redevelopment Plan for the Carlsbad Village Redevelopmen Project Area; and WHEREAS, Section 33334.2 of the Act requires that nl less than twenty percent (20%) of all taxes which are allocated to the Agency pursuant to Section 33670 of the shall be used by the Agency for purposes of increasing a improving the community's supply of low and moderate inc housing; and WHEREAS, pursuant to Section 33334.2 of the Act, th Legislature declares its intent that the Low and Moderat Income Housing Fund shall be used to improve and increas housing in the community; and WHEREAS, to carry out the purposes of increasing an improving the community's supply of low and moderate inc housing, Section 33334.2 (e) of the Act states that the r- " 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 1Y 18 19 20 21 22 23 24 25 26 27 28 0 PAGE 2 RESOLUTION NO. 218 Agency may exercise any or all of its powers, including without limitation, acquiring land or building sites, improving land or building sites with onsite or offsite improvements, donating land to private or public persons entities, constructing buildings or structures, acquirinl buildings or structures, providing subsidies to, or for benefit of, very low income households, lower income households, or persons or families of low and moderate income, or other powers to carry out the purposes of the Act; and WHEREAS, subsection (9) of Section 33334.2 of the A authorizes the Agency to use monies from the Low and Moderate Income Housing Fund inside or outside the Projel Area, but the agency may only use the funds outside the Project Area upon resolution of the Agency and the City Council finding that such use will be of benefit to the Project Area; and WHEREAS, the City Council, serving as the Housing a Redevelopment Commision for the Agency, desires by this resolution to declare that the expenditure of monies fro the Low and Moderate Income Housing Fund outside the Pro Area for the purposes of providing rental subsidies to 1 income will be of benefit to the Project Area; I -. ad 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ,. 27 28 e e PAGE 3 RESOLUTION NO.218 NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, Califo: as follows: 1. That the Recitals above are fully incorporated into this resolution and finding. 2. That the expenditures of monies from the Low a: Moderate Income Housing Fund for the purposes 1 providing rental subsidies to lower income households both inside and outside the Project Area, in which such funds are generated, are a: will be of benefit to the respective Project A: 3. That the Housing and Redevelopment Commission hereby authorizes the Agency to expend a maxim. of $300,000 from the Low and Moderate Income Housing Fund for the purposes of providing a rental assistance program for lower income households. 4. That the Low and Moderate Income Housing Funds will be used in combination with Federal Home Investment Partnership Program Funds (HOME) to finance the costs of providing rental subsidiel lower income households PASSED, APPROVED AND ADOPTED at a regular meeting o the Housing and Redevelopment Commission of the City of Carlsbad held on the 17th day OfNOVEMBER, 1992 by the following vote to wit: AYES: Commissioners Lewis, Kulchin, Larson, Stanton, Nygaarc NOES: None ABSENT : None ATTEST:
