HomeMy WebLinkAbout1995-11-21; Housing & Redevelopment Commission; Resolution 2711 2 3 4 5 6 '7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 HOUSING AND REDEVELOPMENT COMMISSION RESOLUTION NO. 271 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A LOCAL COASTAL PROGRAM AMENDMENT FOR THE VILLAGE SEGMENT OF THE CARLSBAD LOCAL COASTAL ZONE AND A REDEVELOPMENT AREA IMPLEMENTATION AMENDMENT VILLAGE DESIGN MANUAL AND ADOPTION OF A NEW MANUAL ENTITLED THE "VILLAGE MASTER PLAN AND TO TITLE 2, CHAPTERS 2.24 AND 2.26 AND ZONE CODE AMENDMENTS TO TITLE 21, CHAPTERS 21.35, 2 1.41 AND 2 1.81 OF THE CARLSBAD MUNICIPAL CODE TO ENSURE IMPLEMENTATION CONSISTENCY WITH THE NEW MANUAL; AND 3) ADOPTION OF A HOUSING AND REDEVELOPMENT COMMISSION POLICIES AND PROCEDURES MANUAL. CASE NAME: VILLAGE MASTER PLAN AND DESIGN WHICH INCLUDES 1) THE REPEAL OF THE EXISTING DESIGN MANUAL"; 2 ) MUNICIPAL CODE AMENDMENTS MANUAL; MUNICIPAL AND ZONE CODE AMENDMENTS; HOUSING AND REDEVELOPMENT COMMISSION POLICIES AND PROCEDURES MANUAL. CASE NO: LCPA 95-10 WHEREAS, the Carlsbad Redevelopment Agency has fi verified application for an amendment to the Local Coastal PI for the Village Redevelopment Segment of the Carlsbad Coastal Zone (and for all properties located within the Vj Redevelopment Project Area) by adoption of a new Master P1z Design Manual, zone code and municipal code amendments to E consistency with the new manual, and adoption of a Housir Redevelopment Commission Policies and Procedures Manual; a1 WHEREAS, said verified application constitutes a reque! amendment as provided in Public Resources Code Sections et.seq.; and WHEREAS, said verified application also constitutes a rc for amendment of the Redevelopment Plan implementation as prc in the Village Redevelopment Area Land Use Plan; and WHEREAS, the Design Review Board and the Planning Comm: did recommend approval of the subject application; 1 1 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 WHEREAS, the Housing and Redevelopment Commission did c 21st day of November, 19 95, hold a duly noticed public hei prescribed by law to consider said proposed Local Coastal PI Amendment, Zone Code Amendment and Redevelopment implementation amendment; and WHEREAS, at said public hearing, upon hearing and consic all testimony and arguments, if any, of all persons desiring heard, said Housing and Redevelopment Commission considere factors relating to said Local Coastal Program Amendmen Redevelopment Plan implementation amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Housin Redevelopment Commission of the City of Carlsbad, as follov A) That the foregoing recitations are true and corrc B) That based on the evidence presented at the E hearing, the Housing and Redevelopment Commission APPROVES 95-10, which is a Redevelopment Plan implementation amer which includes repeal of the Village Design Manual and adopt: a new Master Plan and Design Manual which includes a Zone Amendment, a Municipal Code Amendment and adoption of the Hc and Redevelopment Commission Policies and Procedures Manu: shown in Exhibits "At1- "C", dated October 4, 1995, as revisec as amended by the Commission or the City Council during the I hearing held on November 21, 1995, as follows and based c following findings: Amendments: 1. Height of project/building may be increased to 45 fec any project which provides a structured parking fac: otherwise maximum height standard shall be 30 feet or 3 depending upon land use district in which proper' located. The following standard shall be deleted from page 5-1 Draft Master Plan and Design Manual: "Total square footage of the sidewalk sign shall be included in the total calculation of maximum signage permitted for an individual business/building based on the standards set forth for the Village Redevelopment Area." 4. The following standards shall be added to the section the Master Plan and Design Manual which addresses Sidewi or Freestanding Signs! "These sign regulations shall be subject to annual review by the Housing and Redevelopment Commission" ; and "All existing building signage for a business must conform to the sign standards set forth within the Master Plan and Design Manual before a permit will be approved for a sidewalk sign"; and "A business arcade or courtyard area shall be allowed only one (1) tenant directory sidewalk sign upon which lists all of the businesses within an arcade or courtyard. Each single business within an arcade or courtyard is not allowed to have an individual sidewalk sign." 1 18 )I Findinss: 19 20 21 22 23 24 25 26 27 1. The proposed amendment to the Local Coastal Program the Village Redevelopment segment of the Carlsbad Lo' Coastal Zone is necessary to ensure the continued succ of revitalization efforts, through the elimination blight and economic development activities, within Village Redevelopment Project Area of the City Carlsbad. I 2. The new land use policies within the Village Master P and Design Manual document provide for adequate visi serving uses and provide for visitor serving commerc uses to satisfy future demand within the Coastal Zone, 3. The proposed amendment is consistent with the Carls: General Plan and the Carlsbad Village Redevelopml Plan/Local Coastal Program Land Use Plan.
