CASE NAME: SCHILLING MIXED USE PROJECT APN: 204-081-01 CASE NO: RP 95-05 WHEREAS, John Schilling, “Developer” has filed a verified application Housing and Redevelopment Agency of the City of Carlsbad regarding property owned b! Schilling, “Owner”, described as Lots 17, 18 and 19 in Block 31, in the City of Carlsbad, 8 9 10 11 San Diego, State of California, according to the map thereof No. 535, filed in the Office o 12 1 5 Redevelopment Permit and Sign Permit known as RP 95-05 for the Schilling Mixed Use P 14 WHEREAS, said application constitutes a request for an extension of a M 13 Recorder of San Diego County, May 2, 1888 (“the property); and originally approved by the Housing and Redevelopment Commission on February 7, 1997 16 17 18 public hearing as prescribed by law to consider said request; and WHEREAS, the Housing and Redevelopment Commission did hold a dul 19 WHEREAS, at said public hearing, upon hearing and considering all testi 20 arguments, if any, of persons desiring to be heard, said Board considered all factors relati 21 22 23 24 25 26 27 28 extension of Major Redevelopment Permit 95-05. .... .... .... .... ..I. .... .... 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e HRC Resolution No. 304 0 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Housing s Redevelopment Commission as follows: A) That the foregoing recitations are true and correct, B) That based on the evidence presented at the public hearing, the Hc Redevelopment Commission hereby APPROVES an eighteen (1 extension of Major Redevelopment Permit 95-05 for the Schilling project, and the related sign permit based on the following finding to the following conditions: GENERAL AND REDEVELOPMENT PLAN CONSISTENCY FINDINGS: 1. The Housing and Redevelopment Commission finds that the subject project is compliance with the Negative Declaration issued by the Planning Director for on August 2, 1996 and approved by the Housing and Redevelopment Commis February 7, 1997. 2. The Project remains consistent with the land use plan, development standards, guidelines and other applicable regulations set forth within the Village Redeve and Village Master Plan and Design Guidelines, with approval of the findings Design Review Board Resolution No. 252 dated October 16, 1996 and appro\ Housing and Redevelopment Commission on February 7, 1997. CONDITIONS: 1. The Housing and Redevelopment Commission does hereby APPROVE an eig month extension of Major Redevelopment Permit 95-05, and the related sign I the Schilling Mixed-Use Project to allow the applicant additional time to appll receive approval of the appropriate building permits for the subject project, SL conditions set forth in Design Review Board Resolution No. 252 dated Octobc and approved by the Housing and Redevelopment Commission on February 7 permit shall be extended eighteen (18) months from the date of original permi which was August 5, 1998. The new expiration date for the permit shall be Fc 2000. PASSED, APPROVED, AND ADOPTED at a SPecia1 meeting oft and Redevelopment Commission of the City of Carlsbad, California, held on the 8th December , 1998 by the following vote to wit: AYES: Commissioners Lewis, Finnila, Nygaard, and Kulcf NOES: None ABSENT: Commissioner Hall ABSTAIN: None I
