HomeMy WebLinkAbout1999-06-08; Housing & Redevelopment Commission; Resolution 3090 0 COMMISSION RESOLUTION NO. 309 1 2 3 4 5 6 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSIO OF THE CITY OF CARLSBAD, AUTHORIZING STAFF TO PROCEED WITE PROGRAMS OUTLINED WITHIN THE PARKING IN THE CARLSBAD VILLA REDEVELOPMENT AREA REPORT. WHEREAS, the Carlsbad Redevelopment Agency has studied various issues related t 1 within the Village Redevelopment Area and set forth its findings and recommendations related needs and demands within a report entitled “Parking in the Carlsbad Village Redevelopment AI WHEREAS, the findings and recommendations set forth within the “Parking in the C 7 8 9 10 11 12 13 Design Review Board for additional public input and recommendations; and 14 WHEREAS, the Design Review Board did hold a public hearing on March 22, 1999 tc 15 public testimony and approved recommendations to the Commission; and 16 recommendations of the Design Review Board as well as any additional public comments on tl 17 WHEREAS, the Housing and Redevelopment Commission has accepted and considen recommendations set forth within the subject parking report. 18 Village Redevelopment Area” Report have been reviewed and considered by the Housing and Redevelopment Commission; and, WHEREAS, the Housing and Redevelopment Commission has accepted the findings ( “Parking in the Carlsbad Village Redevelopment Area” Report; and, WHEREAS, the Housing and Redevelopment Commission referred the subject report 19 NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Corm 2o the City of Carlsbad as follows: 21 22 23 24 25 1. The above recitations are true and correct. 2. That the Housing and Redevelopment Commission accepts the “Parking in the Villl Redevelopment Area” Report, dated January, 1999, which was prepared to documel findings and recommendations related to parking within the Village Redevelopmen 26 27 28 3. That the Housing and Redevelopment Commission has determined that there is adeq public parking available within the Village Redevelopment Area to accommodate ad private development, and to implement the Village Park& In-Lieu Fee Program ac the program description and requirements set forth within the approved Village Mas and Design Manual, and reiterated within the subject parking report. 5. That the fee for participation in the Village Parking In-Lieu Fee shall be set at $11,2 parking space required and to be provided off-site within a public parking lot, and SI subject to annual review by the Housing and Redevelopment Commission. 6. It has been determined that the Village Parking In-Lieu Fee represents one of sever: provided to a private developer within the Village Redevelopment Area for satisfyir site parkng obligation and shall be paid via an agreement between the Redeveloprnl Agency and the individual property and/or business owners. Because fees collected to agreements with redevelopment agencies are not considered to be a ‘‘Developme] Fee”, the Parking In-Lieu Fee is not subject to the regulations set forth within Gove Code Section 66000(b) for “Development Impact Fees”. 7. The fee set forth in Paragraph #5 above shall become effective sixty (60) days after adoption of this resolution. 8. The Housing and Redevelopment Commission hereby authorizes the Executive Di his designee to proceed with processing of an Ordinance to expand implement three parking within the core Village Area for all streets and public alleys within the desi boundaries which currently allow for parking, to be effective Monday through Satu 7:OOam to 6:00pm, excluding holidays. 9. The Housing and Redevelopment Commission hereby authorizes the Executive Dir designee to proceed with actions to implement three (3) hour time limits within thr existing public parking lots as designated within Exhibit 4 of the Parking in the Vil, Redevelopment Area Report, dated January, 1999, with the exception that two (2) 1: spaces within the South Depot Parking Lot shall be further restricted to thirty (30) 1 exclusive use of visitors to the Carlsbad Convention and Visitors Bureau Office. 2 11 HRC Resolution No. 30 B 0 1 II 10. The Housing and Redevelopment Commission hereby authorizes the Executive Dire 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 designee to strictly enforce the existing and future parking time limits as set forth in Paragraphs #8 and #9 above, following complete implementation of a public relatio: program to broadly promote and clarify the intent of the parking enforcement efforts 1 1. The Housing and Redevelopment Commission hereby authorizes the Executive Dire designee to develop and implement a program, or campaign, to encourage the gener, to use the fkee public parking lots already available within the Village and to promo1 about” in the area. 12. The Housing and Redevelopment Commission hereby authorizes the Executive Din designee to develop and implement a program to assist existing propertyhusiness o redesign their private parking lots, as appropriate, to increase their effectiveness, an encourage cooperation between property owners in the use of these private parking 13. The Housing and Redevelopment Commission hereby authorizes the Executive Dirt designee to take appropriate actions to pursue acquisition of property, or control of: structure site, as identified within the Parking in the Carlsbad Village Redevelopme Report as opportunities are presented and according to applicable Redevelopment A policies and procedures. 14. The Housing and Redevelopment Commission hereby instructs the Executive Director or h 2 to complete semi-annual parking studies of the public parking lots located within the Villa 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Redevelopment Area to ensure that any increase (or decrease) in parking demand is proper and calculated into any future need for additional public parking facilities. PASSED, APPROVED AND ADOPTED at a regular meeting of the Housinl Redevelopment Commission of the City of Carlsbad, California, on the 8th dq of June ,1999, by the following vote, to wit: AYES: Commissioners Lewis, Finnila, Nygaard, and Kulchin NOES: None ABSENT: Commissioner Hall ABSTAIN: None Secretary I 4
