HomeMy WebLinkAbout1977-07-05; Housing Authority; Resolution 881 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Resolution No. 88 W A RESOLUTION BY THE HOUSING AUTHORITY OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE LEASE FOR THE THIRTY-FIVE ONE-BEDROOM UNITS LOCATED AT 3380 HARDING ST, The Housing Authority of the City of Carlsbad does hereby authorize and instruct the Secretary to execute the attached amend- ment to the lease for the units located at 3380 Harding St. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Housing Authority of the City of Carlsbad held on the fifth day of juiy , 197_7_, by the following vote, to wit: AYES: Casler, Skotnicki, Packard, Lewis, and Frazee NOES: ABSENT: ROBERT C. FRAZEE, Chairman ATTEST: ROBERT J. COLES, Secretary S-E-A-L FIRST AMENDMENT TO LEASE BETWEEN GENE BAKER DE LOACH AND THE CARLSBAD HOUSING AUTHORITY FOR THE UNITS LOCATED AT 3380 HARDING STREET THIS FIRST AMENDMENT TO LEASE is made this day of , 19 between Gene Baker De Loach (hereinafter referred to as Owner), and the City of Carlsbad Housing Authority(here- inafter referred to as Authority) RECITALS:1. The Owner hereby agrees to exercise her option, pursuant to Paragraph 3.b. of the Lease, to renew the Lease for an additional term of five years. 2. In accord with Authority Resolution Nov , Section 4 of the Lease is hereby amended to read as follows: 4. RENT PAYMENTSA. Effective June 1, 1977, the rents will be as follows: Monthly Rent Total Monthly Description No. of Units Per Unit Rent Ibr 35 $168.QO $5,880.00 B. The rents will be adjusted annually, on June 1, for the remaining period of the lease, using the following formula: Fair Market Rent, as established by HUD, as of date rental adjustment due, minus Si for Management Fees, minus Utilities Allowance as per schedule in use on the date the rental adjust- ment is due. C. A special adjustment, subject to Authority approval, may be made to reflect increases in the actual and necessary expenses of owning and maintaining the unit which have resulted from substantial general increases in real property taxes, utility rates or similar costs (i.e., assessments, and utilities not covered by regulated rates), but only if and to the extent that the Owner clearly demonstrates that such general increases have caused increases in the Owner's operating costs which are not adequately compensated for by the annual adjustments provided for in paragraph 4.B. The Owner shall submit financial statements which clearly support the increase. Such adjustment shall be effective as of the date mutually agreed upon by the Authority and Owner upon request by the Owner.
