HomeMy WebLinkAbout1996-11-14; Housing Commission; Resolution 96-012b r. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 HOUSING COMMISSION RESOLUTION NO. 96-01 2 A RESOLUTION OF THE HOUSING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA TO RECOMMEND APPROVAL OF FINANCIAL ASSISTANCE FOR THE PURPOSE OF REHABILITATING AND PROVIDING AFFORDABLE RENTAL HOUSING AT 965 LAGUNA DRIVE. APPLICANT: MICHAEL BOARDMAN CASE NO.: AHP 96- 01 2 WHEREAS, an Affordable Housing Project (AHP) Application (No. 96-01 2) has been submitted to the City of Carlsbad's Housing Commission for review and consideration by the applicant; and WHEREAS, the applicant has expressed a need to receive financial assistance in the amount of $12,750 per housing unit or a total of $216,750 from the City of Carlsbad Redevelopment Low and Moderate Income Housing Set-Aside Fund for the purpose of rehabilitating and providing 17 rental units as affordable housing at the subject property; and WHEREAS, said Housing Commission did, on the 14'h day of November, 1996, hold a public meeting to consider said application with the request for financial assistance; and WHEREAS, as said public meeting, upon hearing and considering all testimony, if any, of all persons desiring to be heard, said Commission considered all factors relating to the application and request for financial assistance; and WHEREAS, the Housing Authority of the County of San Diego would administer the rehabilitation of this project on behalf of the City of Carlsbad and in accordance to the City's existing Agreement with the Housing Authority for Administration of a Home Ownership and Rental Residential Rehabilitation Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Housing Commission of the City of Carlsbad, California, as follows: 1. The project is consistent with the goals and objectives of the City of Carlsbad's Housing Element and Consolidated Plan. The project will provide a total of 17 rental units (3 and 4 bedrooms) affordable to households at 80% or below the county median which meets a "medium" priority as outlined within the City of Carlsbad's Consolidated Plan. The project has the ability to effectively serve the City's Housing needs and priorities as expressed in the Housing Element and the Consolidated Plan. The project appears to be cost effective based on the value of the affordability restrictions and the financial assistance recommended. That based on the information provided within the application and testimony presented during the public meeting of the Housing Commission on November 14, 1996, the Commission recommends APPROVAL of financial assistance requested by the applicant for the residential rehabilitation project in an amount not to exceed $216,750 or $12,750 per unit in the form of a no interest deferred loan from the City of Carlsbad's Redevelopment Low and Moderate Income Set-Aside Fund, subject to the appropriate and necessary findings of consistency with Callifornia Redevelopment laws. That the Housing Authority of the County of San Diego will administer the rehabilitation of the subject property on behalf of the City of Carlsbad and consistent with the conditions contained herein and the Housing Authority's established residential rehabilitation program requirements and restrictions. That the City Manager or his designee is authorized to enter into additional agreements with the Housing Authority of the County of San Diego or the applicant, execute such other documents, or take other actions as may be necessary or appropriate to implement said residential rehabilitation project. General Conditions: 1. 2. 3. Financial assistance shall be subject to the residential rehabilitation program requirements and restrictions established by the Housing Authority of the County of San Diego, with the exception of the conditions contained herein. All 17 housing units must have rents, including a reasonable utility allowance, that do not exceed 30 percent of the adjusted income of a family at 60 percent of the median income for San Diego County, adjusted for the number of bedrooms in the unit. Once initial rents are established, any rent adjustments thereafter will be based on the U.S. Department of Housing and Urban Development (HUD) annual income adjustments. All residential units are to be occupied by low income tenants with incomes at or below 80 percent of the County median income. To ensure affordable rent and occupancy restrictions, the subject property shall be deed restricted for a minimum of 20 years. Upon final approval of financial assistance by the Housing and Redevelopment Commission subject to the appropriate and necessary findings consistent with California Redevelopment Laws for said residential rehabilitation project, the applicant shall enter into a loan agreement with the Housing Authority of the County of San Diego, as the administrator of the City of Carlsbad's Residential Rehabilitation Program. The loan agreement shall include all terms and conditions of said project approval; the amount and form of the City's financial assistance; compliance reporting requirements and implementation agreements. The agreement shall also include a requirement that each unit within the project pass annual Housing Quality Standards (HQS) inspections. If the units do not pass the HQS inspections, the loan can be recalled after giving the applicant an adequate and reasonable period of time to correct any recorded violation. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Housing Commission of the City of Carlsbad, California, held on the 14'h day of November, 1996, by the following vote, to wit: AYES: Chairperson Calverley, Commissioners: Escobedo, Noble, Rose, Sato, Scarpelli, Schlehuber, Walker & Wellman.
