HomeMy WebLinkAbout1956-04-16; Municipal Water District; Resolution 20RESOLUTION No. RESOLUTION OF THE BOARD OF DIIBCTORS OF THE CARLSBAD WNICIPAL WAmR DISTRICT DECLARING THE NECESSITY FOR INCURRIIG A BONDED INDEBTEDNESS TO BE PAYABLE FROM TAXES UVIED UPON LESS THAN ALL OF THE DISTRICT AND FIXING TIME AND PLACE OF IEARING AND GIVING NOTICE OF HEARING. WHEREAS, the Board of Directors of CARLSEW MTlLICIPAL WATER DISTRICT deems it necessary for the district to incur a bonded indebtedness to be payable from taxes levied upon less than all of the district. NOW, TREREFORE, the Board of Directors of CARLSBAD MUNICIPAL MATER DISTRICT DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: c Section 1. That it is deemed necessary for said district to incur a bonded indebtedness, to be payable fromtaxes levied upon less than all of the district for thd purpose of the acquisition and construction of a water transmission pipeline with appurtenances and appurtenant works from the facilities of the San Diego County Water Authority located in the An boos, Escondido Area (at a point to be approved by the San Rego County Water Authority) to a point within the Carlsbad Municipal Water District east of Mghland Avenue, in= cluding works, machinery and other property (including lands and easements) useful and necessary to store, convey, supply and otherwise make use of water for the lands and inhabitants within a portion of said Carlsbad Municipal Water District, and including expenses of all proceedings for the authorization, issuance and sale of the bonds? Section 2. That the amount of the proposed debt to be incurred for which bonds are to be issued therefor is the sum of $1,333,000, Section 3. That this Board intends to form an improvement district of a portion of the district which in the opinion of the hard will be benefited, the exterior boundaries of which portion are set forth on a map on file with the Sec- retary of the district, which map shall govern for all details as to the extent of the proposed improvement district, and to call an election in such proposed improve- ment district on a date to be fixed, for the purpose of subitting to the qualified voters thereof the proposition of incurring indebtedness by the issuance of bonds of the district for said improvement district. , l c Section 4. That taxes for the payment of said bonds and the interest thereon shall be levied exclusively upon the taxable property in the improvement district. Section 5. That a general description of the proposed improvement, to- gether with a map showing the exterior boundaries of said proposed improvement district with relation to the territory immediately contiguous thereto and to the proposed improvement is on file with the Secretary of the district and is avail- able for inspection by any person or persons interested. 7:30 o'clock P.M., on said day, is hereby fixed as the time, and the meeting place of the bard of girectors of the Carlsbad Municipal Water District at the Carlsbad City Hall, 2960 Pi0 Pic0 Boulevard, Carlsbad, California, is hereby fixed as the place for a hearing by the Board of Directors of said district on the questions of the formation of said proposed improvement district, the extent thereof, the pro- posed improvement and the amount of debt to be incurred. place any person interested, including all persons owning property in the district or in the proposed improvement district, will be heard.
