ING BGAL COUNSEL OF DISTRICT TO MTTHDRAV PENDIRG APPLICATION OF DISTRICT TAX BEFORE
STATE WATER RIGHTS BOARD TO APPROPRIATE UNAPPROPRIATED 'IJATER FRO14 AGUA HEDIOIJDA
CREEK.
WEREAS, the District has filed an application to appropriate unappropriated
water from Agua Hedionda Creek, within the boundaries of said district, with the
State Water Rights Board, State of California; said application numbered 17348; and

WHEREAS, said application is now pnding; and
WHIREM, the District Engineer has submitted a report to the District as
to the estimated cost of a reservoir project of the District to be connected with
said application to appropriate unappropriated water; and
WHEREAS, The Board of Directord of the Mstrict are of the opinion that the District would not be in a position to undertake said reservoir project within the immediate future, and as such would not be able to complete the project within a reasonable time, even if the said application was approved;
WEREAS, the Board of Directors of the District deem it to the best inter- ests of the District to withdraw said pending application before said State Water
Rights Board.
VOW THEREFORE, THE BOARD OF DIWCTORS OF THE CARLSRAD MUNICIPAL WATER DU- TRICT DOES FEREBY RESOLVE, DETERYDE AS FOLLOWS:
1. That it is to the best interests of the District to withdraw the pend-
ing application of the District to appropriate unappropriated water frm Agua Hedionda
Creek as filed with the State Water Rights Board, State of California.
c 2. That the legal counsel for the District is hereby authorized and directed
to take any necessary steps to withdraw said application.
