RESOLUTION NO. 109
RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT ORDERING THAT NO ELECTION SHALL BE HELD IN DIVISION NO. 3 and DIVISION NO. 4 OF THE CARLSBAD MUNICIPAL WATER DISTRICT IN ACCORDANCE WITH SECTION 4.1, MUNICIPAL WATER DISTRICT ACT OF 19 11, AS AMENDED AND DIRECTING SECRETARY OF THE BOARD OF DIRECTORS TO REQUEST THE BOARD OF SUPERVISORS OF
SAN DJEGO COUNTY TO APPOINT FRED W. MAERKLE AS DIRECTOR FROM DIVISION NO. 3 OF SAID WATER DISTRICT AND RICHARD R. COE AS DIRECTOR FROM DIVISION NO. 4 OF SAID WATER DISTRICT.
WHEREAS, the sixty-fifth day prior to the day fixed for the district
general elections has passed; and
'WHEREAS, only one person has been nominated to serve as a member
of the Board of Directors of Carlsbad Municipal Water District from Division
No. 3 and from Division No. 4 of said district; and
WHEREAS, FRED W. MAERKLE is the only person who has been
nominated to serve as a member of the Board of Directors of Carlsbad Municipa
Water District from Division No. 3 of said District; and
WHEREAS, RICHARD R. COE, is the only person who has been
nominated to serve as a member of the Board of Directors of Carlsbad
Municipal Water District from Division No. 4 df said District; and
WHEREAS, Section 4. 1 of the Municipal Water District Act of 19 11, as
amended, requires that the Board of Directors of the water district shall pass a
/ resolution that an election shall not be held when only one person has been
nominated to serve as a member of the Board of Directors of water district
within any one division.
NOW THEREFORE, THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:
1. That anelection shall not be held in Division No. 3 and Division
No. 4 of Carlsbad Municipal WaterDistrict on June 7, 1960.
2. That the Secretary of this Board is hereby directed to enter this
resolution in full in the minutes of this Board.
3. That the Secretary of this Board is directed to forward a copy of this
resolution to the Board of Supervisors of San Diego County with the request
that the said Board of Supervisors appaint FRED W. NLAERKLE to the office
of a member of the Board of Directors of Carlsbad Municipal Water District

Board of Directors of Carlsbad Municipal Water Districtkom Division No. 4 in
accordance with Section 4. 1 of the Municipal Water District Act of 19 11, as
amended.
ADOPTED, SIGNED, AND APPROVED this 19th day of A pril, 1960.
