RESOLUTION NO. 118
A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC INTEFtEST, CONVENIENCE, AND NECESSITY OF THE CARLSBAD MUNICPA
WATER DISTRICT REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A WATER RESERVOIR AND APPURTENANCES TJ3ERETO UPON CERTAIN LANDS LOCATED IN COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF LANDS FOR SAID WATER
RESERVOIR AND APPURTENANCES THERETO AND DECLARING THE
INTENTIONS OF SAID CARLSBAD MUNICIPAL WATER DISTRICT TO COMMEI
AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA, IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF CONDEMNIN( SAID LANDS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT AS FOLLOWS:
1. That the public interest, convenience and necessity of CARLSBAD
MUNICPAL WATER DISTRICT, a municipal water district organized and
existing under the Municipal Water District Act of 1911, as amended, and the
inhabitants thereof, require the construction, operation and maintenance of a
water reservoir and appurtenances thereto upon certain lands hereinafter more
particularly described; said lands located within the County of San Diego, State
of California.
2. That the public interest, convenience and necessity of said
CARLSBAD MUNICIPAL WATER DISTRICT and the inhabitants thereof demand
the acquisition and taking of lands for the said water reservoir and appurtenanc
the reto.
3. That the taking and acquiring by said CARLSBAD MUNICIPAL
WATER DISTRICT of the lands hereinafter described is deemed necessary for
the construction, operation, and maintenance of said water reservoir and
appurtenances thereto.
4. That such use is a public use and that for such public use it is
necessary that said CARLSBAD MUNICIPAL WATER DISTRICT condemn and
acquire said land.
5. That the law firm of SMITH and SWIRSKY, Attorneys at Law, be
and they are hereby authorized and directed to commence an action in the
Superior Court of the State of California in and for the County of San Diego, in

the name of and on behalf of the Carlsbad Municipal Water District against all
owners and claimants of the hereinafter described property for the use of said
Carlsbad Municipal Water District; that said condemnation action shall be
prosecuted in accordance with the provisions of law applicable thereto.
6. That the property to be taken by said Carlsbad Municipal Water
District is described as follows:
A fee simple interest in and to the following described real property situated in County of San Diego, State of Califwnia, particularly described as follows :
That portion of Lot C in Rancho Agua Hedionda according to Map thereof No. 823 filed in the Office of The Recorder
of San Diego County, California, described as follows:
Beginning at Pt. 3 of said Lot C; thence North 84"20'00"
East, 1934. 00 feet; thence South 35°10'00'i East, 270. 00 feet; thence South 05°10'00ps East; 300.00 feet; thence South 50" 50'00" West, 460. 00 feet; thence South 10"20100" West, 350. 00
feet; thence South 30°20'00" West, 275. 00 feet; thence South 65°20100" West, 300. 00 feet; thence South 89"39'00" West, 1268 feet to a point in the West line of said Lot C; thence Northerly along said West line 1334 feet to the POINT OF BEGINNING, containing 59. 6 1 acres, more or less.

foregoing resolution was duly adopted by the Board of Directors of said
district at a regular meeting of the said board held on the 17th day of
November, 1959, and that it was adopted by the following vote:

ABSTAINING: Director Carnohan.
