RESOLUTION OF THE BOARD OF DIRECTORS OF CARISBAD blUNICIPAL WATER DISTRXCT URbER- XNG, CALLING, PROVIDING FOR, AND GNmG NOTICE OF A SPECIAL ELECTION TO BE MR;D IN WROVEEJSENT DISTRICT NO. 4 OF SAID FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTlERS OF SAID IMPFNJVEMEXT DISTRICT A PROPOSITION OF INCURRING BONDED INDE23TEDNESS AND ISSUING BONDS OF SAID DISTRICT FOR SAID IMPROVEMENT DISTRICT. DISTRICT ON TUESDAY, JANVARY 24, 1961, The Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT does hereby RESOLVE, DETERMINE AND ORDER as follows: I Section 1. That this Board deems it necessary that the CARLSBAD MUNICIPAL WATER DISTRICT incur a bonded indebtedness by the issuance of bonds of the district for Improvement District No. 4 thereof in the amount of six hundred ninety thousand dollars ($690,000) for the purpose of the acquisition and construction or 8 waterworks system, including a dam and a reservoir, and including for the foregoing conduits, pipelines, works, machinery and other property (including lands and easements) useful or necessary to store, convey, supply or otherwise make use of water for the lands and inhabitants within the exterior boundaries of said Improvement Dis- trict No. 4, and including expenses of all proceedings for the authorization, issuance and sale of the bonds. That, following a hearinrg thereon as by law provided, this Board has determined, and does hereby determine and state, that the portion of said district which will be benefited by the accomplishment of said purpose hereinabove stated and by incurring said bonded indebtedness constitutes and is known as "IMPRCVEMENT DISTRICT NO. 4 OF CARLSBAD MUNICIPAL WATER DISTRICT" and that a map showing the exterior boundaries of said improve- ment district is on file with the Secretary of said district, which map shall govern for all details as to the extent of the improvement district. Section 3. That the maximum term which the bonds proposed to be issued, or any portion or series thereof, shall run before maturity shall not exceed the maximum term per- mitted by law, to wit, forty (40) years from the date of said bonds or each series thereof, but said bonds may be made to mature within a lesser number of years; that the maximum rate of interest to be paid thereon shall not exceed the maxi- mum rate permitted by law, to wit, five per cent (5%) per annum, payable semiannually, except that interest for the firat year shall be payable at the end of said year3 the actual rate or rates to be determined at the time of the sale or sales $hereof. Section 4. That a special electlon be held, and - the 8ame is hereby called to be held, in said Improvement District No, 4 of Carlsbad Municipal Water District 2. Munic.W.D,(lgll) 1mpr.D. Rem. Elec*n the 24th day of January , 19 61 , for the purpose of submitting to the qualified voters of said improvement dis- trict the proposition of incurring the said indebtedness and issuing bonds of said district for said improvement district, in the amount hereinabove set forth, and for the purpose hereinabove stated. That if the proposition for the incurring of said indebtedness so submitted receives the requisite number of votes, to wit, more than two-thirds of the votes of the quali- fied voters voting at such election, bonds of said district for said improvement district in not exceeding the principal amount hereinabove stated shall be issued and sold for the purpose hereinabove set forth. Said bonds will be bonds of the district, but taxes for the payment of such bonds and the interest thereon shall be. levied exclusively upon the taxable property within said Improvement Dfstrict No. 4 Carlsbad Municipal Water District all as provided in the Municipal Water District Act of 1911, as amended. of Section 5. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be olosed, exoept as provided in Section 5734 of the Elections Code of the State of California. Section 6. That on the ballots to be used at said election, in addition to any other matters required by law, there shall be printed substantially the following: 3. BOND PROPOSITION: Shall the Carlsbad Municipal Water District incur a bonded indebtedness for Improvement District No. 4 thereof' in the principal sum of $690,000 for the acquisition and construction of a waterworks system, including a darn and a reservoir, and including for the foregoing conduits, pipelines, works, machinery and other property (including lands and ease- ments) useful or necessary to store, convey, supply or otherwise make use of water for the lands and inhabitants with- in the exterior boundaries of said Im- provement District No. 4, and including expenses of all proceedings for the authorization, issuance and sale of the bonds? . . 4. Section 7. A cross (i) placed in the voting square after the word "YES" in $he manner hereinbefore provided shall be counted in favor of the adoption of the question or propo- sition, word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. That in all particulars not recited in this resolution, said election shall be held and con- ducted in accordance with the provisions of the Elections Code of the State of California so far as the same shall be applicable, except as otherwise provided in the Municipal Water District Act of 1911, as amended. Section 10. That the Secretary of this Board shall cause this resolution to be published once a week for two (2) successive weeks prior to the date of the election in CARLSBAD JOURNAL a newspaper of general circulation printed and published in the district. Said resolution shall also be posted in three (3) public places within said Improvement District No. 4 the election. not less than two (2) weeks prior to the date of ADOPTED, SIGNED AND APPROVED this 6th day of December j 19 60.
