HomeMy WebLinkAbout1961-03-21; Municipal Water District; Resolution 136RESOLUTION NO. 136 A RESOLUTJON DETERMINING AND DECLARING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY OF THE CARLSBAD MUNICIPAL WATER DISTRICT REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A WATER RESERVOIR AND APPURTENANCES THERETO AND WATER PIPELINES WITH APPUR- TENANCES THERETO UPON CERTAIN LANDS LOCATED IN COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF LANDS FOR SAID WATER RESERVOIR AND APPURTENANCES THERETO AND WATER PIPELINES WITH APPURTENANCES THERETO AND DECLARING THE INTENTIONS OF SAID CARLSBAD MIJNICLPAL WATER DISTRICT TO COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA, IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF CONDEMNING SAID LANDS. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT AS FOLLOWS : 1. That the public interest, convenience and necessity of CARLSBAD MUNICIPAL WATER DISTRICT, a municipal water district organized and exist - ing under the Municipal Water District Act of 1911, as amended, and the in- habitants thereof, require the construction, operation and maintenance of a water reservoir and appurtenances thereto and water pipelines with appurtenances thereto upon certain lands hereinafter more particularly described; said lands located within the County of San Diego, State of California. 2. That the public interest, convenience and necessity of said CARLSBAD MUNICIPAL WATER DISTRICT and the inhabitants thereof demand the acquisition and taking of lands for the said water reservoir and appurtenances thereto and water pipelines with appurtenances the reto. 3. That the taking and acquiring by said CARLSBAD MUNICIPAL WATER DISTRICT of the lands hereinafter described is deemed necessary for the con- struction, operation, and maintenance of said water reservoir and appurtenances the ret o and w at e r pip el ine s with ap pu r t e nan c e s the ret o . 4. That such use is a public use and that for such public use it is necessary that said CARLSBAD MUNICIPAL WAmR DISTRICT condemn and acquire said land. 5. That the law firm of SMITH and SWIRSKY, Attorneys at Law, be and they are hereby authorized and directed to commence an action in the Superior Court of the State of California in and for the County of San Diego, in the name of and on behalf of the Carlsbad Municipal Water District against all owners and claimants of the hereinafter described property for the use of said Carlsbad Municipal Water District; that said condemnation action shall be prosecuted in accordance with the provisions of law applicable thereto. 6. That the property to be taken by said Carlsbad Municipal Water Dis - trict is described as follows: PARCEL A A fee simple interest in and to the following described real property situated in the County of San Diego, State of California, particularly described as follows : That portion of Lot "D" of Rancho Agua Hedionda, in the County of San Diego, State of California, according to Partition Map No. 823 filed in the office of the County Recorder of San Diego, November 16, 1896, described as follows: Beginning at Point 4 of Lot "D" as shown on said Partition Map No. 823; thence North 01°46t56" East 2637.98 feet to Point 5 of said Lot "D"; thence North 65°57r53" West 10. 38 feet; thence North 24°02107tt East 427.94 feet; thence North 05°14126" East 287. 60 feet; thence North 18°02f37" East 497.21 feet to the TRUE POINT OF BEGINNING; thence North 71O57'23" West 70.00 feet; thence North 18°02'37" East 165.00 feet; thence South 71°57*23" East 145.00 feet; thence South 18°02137" West 165.00 feet; thence North 71O57' 23" West 75.00 feet to the TRUE POINT OF BE- GINNING; containing 0.55 acres, more or less.
