ACCEPTANCE OF THE GRANT OFFER
WHEREAS, there has been filed with the Government in behalf of Carlsbad
Municipal Water District (herein called the Applicant) an application, Project
Number APW-CALIF-266 dated October 16, 1962, for Federal assistance under the
P
Public Works Acceleration Act, Public Law 87-658, and the UNITED STATES OF
AMERICA, acting by and through the Regional Director of Community Facilities,
has transmitted to the Applicant for acceptance a Grant Offer dated March 4, 1963
of Federal assistance in connection with the Project referred to in said application
and described in said Offer; and
WHEREAS, said Grant Offer has been fully considered in accordance with all
pertinent rules of procedure and legal requirements, and made a part of the
Applicant’s public records; and
WHEREAS, it is deemed advisable and in the public interest that said Grant
Offer be accepted;
NOW, THEREFORE, be it Resolved by the Board of Directors of Carlsbad Municipal
c Water District that the said Grant Offer, a true and correct copy of which, including
the Terms and Conditions, is hereto attached, be and the same hereby is accepted
without reservation or qualification and BE IT FURTHER RESOLVED that the applicant
will within sixty (60) days from the above date furnish the Government satisfactory
evidence that its share of the project cost is available or that firm and binding
arrangements have been entered into to provide such funds as they are needed to meet
project costs and that the applicant agrees that its failure to do so will autbmatically
cancel the Grant Offer and this Acceptance thereby releasing Federal Government from
any and all claims or liabilities in connection with this Grant and/or project.
PASSED by the aforementioned governing body of the Applicant on the 13th day of
March, 1963.

CERTIFICATE
I, the undersigned, the duly qualified and acting Secretary of the Board
of Directors, of Carlsbad Municipal Water District, and Custodian of the records
of said body, including its journal of proceedings, do hereby certify:
1. That the attached Resolution No. 170 is a true and correct copy of a -
Resolution as finally adopted at a Special meeting of the Board of
Directors of Carlsbad Municipal Water District, that said Resolution
has not been amended, modified or rescinded, and is now in full force

and effect;
That said meeting was duly convened and held in all respects in
accordance with law and, to the extent required by law, due and
proper notice of such meeting was given; that a legal quorum was
present throughout the meeting and a legally sufficient number of
the aforesaid governing body voted in the proper manner for adoption
of said Resolution; that all other requirements and proceedings under
the law incident to the proper adoption or passage of said Resolution,
including the publication, if required, have been duly fulfilled, carried
out, and otherwise observed; that I am authorized to execute this
Certificate; and that the seal of Carlsbad Municipal Water District is
hereto affixed and this Certificate is hereby executed under such
official seal.
