HomeMy WebLinkAbout1963-09-03; Municipal Water District; Resolution 177RESOLUTION NO. 177 A resolution determining and declaring that the public interest, convenience, and necessity of the CARLSBAD MUNICIPAL WATER DISTRICT require the construction, operation and maintenance of a sewer disposal plant and appurtenances, thereto upon certain lands, located in the County of San Diego, State of California, and that the public interest, convenience and necessity demand the acquisition of lands for said sewer disposal plant and appurtenances thereto, and declaring the intention of said CARLSBAD MUNICIPAL WATER DISTRICT to commence an action in the Superior Court in the State of California, in and for the County of San Diego for the purpose of condemning said land. BE IT RESOLVED by the Board of Directors of Carlsbad Municipal Water District as follows: 1. That the public interest, convenience and necessity of Carlsbad Municipal Water District, a Municipal Water District, organized and existing under the Municipal Water District Act of 1911, as amended, and the inhabitants thereof, require the construction, operation and maintenance of a sewer disposal plant and appurtenances thereto upon certain lands hereinafter more parti- cularly described; said land are located within the County of san Diego, State of California. 2. That the public interest, convenience and necessity of said Carlsbad Municipal Water District, a municipal water district, and the inhabitants thereof, demand the acquisition and taking of lands for said sewer disposal plant and appurtenances thereto, 3. That the taking and acquiring by said Carlsbad Municipal Water District of the land hereinafter described, is deemed necessary for the construction, operation and maintenance of said sewer disposal plant and appurtenances thereto. 4. That such use is a public use and that for such public use, it is necessary that said Carlsbad Municipal Water District condemn and acquire said land, in fee title. 5. That the law firm of Andreasen, Thompson, Fore & Grosse, attorneys at law, be and they are hereby authorized and directed to commence an action in the Superior Court of the State of California, in and for the County of San Diego, in the name of and on behalf of the Carlsbad Municipal Water District to give all owners and claimants of the hereinafter described property for the usg of said Carlsbad Municipal Water District; that said condemnation action shall be prosecuted in accordance with the provisions of law applicable here to. 6. That the property to be taken by said Carlsbad Municipal Water District is described as follows: Lots 1 and 2 in Fractional Section 20, Township 12 South, Range 4 West, San Bernardina Meridian, in the County of San Diego, State of California, according to United States Government Survey approved October 2 5, 1875. Excepting that portion lying within the exterior boundaries of LaCosta Downs Unit No. 1, according to Map thereof No. 2013, filed in the Office of the County Recorder of San Diego County, April 6, 1927. . Also excepting any portion lying North of the South line of Rancho Agua Hedionda, according to Government Survey of said South line approved September 17, 1915, as shown on Map in Case No. 16830 in the Superior Court of said San Diego County. Also excepting that portion lying Easterly of the following described line: Beginning at a point in the North line of Lot 1 in said Section 20, Township 12 South, Range 4 West, San Bernardino Meridian, in the County of San Diego, State of California, distant thereon South 89O 55' 40" East 615. 92 feet from the center line of State Highway as shown on Licensed Surveyor's Map No. 339, filed in the Office of the County Recorder of said County; thence Southeasterly in a direct line 1680 feet more or less to the Northwesterly corner of Lot 1 in Block 22, LaCosta Downs, Unit No. 1. Also excepting those portions lying Westerly of the Easterly lines of the portions of land described in Deeds to State of California recorded on December 31, 1951, in Book 4332, pages 306 and 310 of Official Records of said County, as Documents Nos. 156623 and 156625. And also excepting from said Lot 2 that portion, if any, lying South of the North line of the South 60 acres of Lots 1, 2, and 3, Southeast Quarter of Southeast Quarter of Section 20, and Lot 4 and Southwest Quarter of Southwest Quarter of Section 21, Township 12, South, Range 4 West, San Bernardino Meridian, according to United States Government Survey approved October 25, 1875. Also excepting that portion of land lying Southerly of the fol- lowing described line: Beginning at the intersection of the Southerly line of Rancho Agua Hedionda and the Westerly line of the Atcheson, Topeka and Santa Fe Railway Right of Way; thence Southerly along said Westerly line of the railroad right of way, 1,000.00 feet to the True Point of Beginning; thence Westerly along a line parallel to the Southerly line of Rancho Agua Hedionda to the intersection with the Westerly line of said Parcel.
