A RESCB;UTION OF ME BOARD OF DIRECTCRS OF CARLSBAD
MUNICIPAL WLTER DISTRICT WAIVING THE CARLSBAD MUNICIPAL rJATER DISTRICT'S RIGHT TO LIQUIDATED DAMAGES FOR DELAY
IN COMPLETION OF CONSTRUCTION OF ADMINISTRATION AND
WAREHOUSE BUILDING.
m, Carlsbad Municipal Water District and Betravn Construction
Company have heretofore entered into a contract for the construction of
an Administrative and Warehouse Building, which contract was accepted by
Resolution No. 174; and
WHEREAS, said contract called for liquidated damages for delay
in completion; and
WHWEAs, completion was to be as of November 25, 1963, but #id
not occur until Decemher 17, 1963; and
FJHEREAS, by consent of Betraun Construction Company the Carlsbad
Municipal Water District went into partial occupancy on November 22, 1963.
NOW THEREFORE IT IS RESOLVED that for and in consideration of the
early occupancy granted to the Carlsbad Municipal Water District by the
Betraun Construction Company, the Carlsbad Municipal Water District's right
to liquidated damages for delay in the completion of the Administration and
Warehouse Building, being Project No. APW-Calif.-26GY is hereby waived.
BDUPTED, SIGNED AND APPROVED THIS 7th day of January, 1964.
