HomeMy WebLinkAbout1965-06-15; Municipal Water District; Resolution 196RESOLUTION NO. 196 A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT TO FIX RATES AND CHARGES FOR WATER SUPPLIED BY DISTRICT TO USERS AND TO REPEAL RESOLUTIONS 179 and 187. c WHEREAS, ARTICLE I11 of Ordinance No. 22 , provides that the water rates and charges shall be fixed by Resolution; and WHEREAS, existing Resolutions relating to rates and charges are deemed inadequate and/or obsolete; and WHEREAS, the Board of Directors of the Carlsbad Municipal Water District deems it expedient, proper and necessary to revise its schedule, rates and charges. DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT, as follows: NOW, THEREFORE, BE IT RESOLVED BY THE B0AR.D OF 1. Resolutions No. 179 and 187 are hereby rescinded. 2. The rates charged and collected for all water delivered by District, and a charge hereinafter called "Ready-to-Serve Charge" to be applied to and collected on each active connection, are as follows: a. Wholesale. $12.00 per acre foot per month plus the average cost of the water to the District for the preceding month, which shall be the amount charged by the San Diego County Water Authority and the cost of chlorine used for water purification. $13.00 per acre foot per month for water sold for use in Improvement Districts 2 and 3, and a charge of $1. 00 per acre foot per mile per month of said Improvement Districts 2 and 3 pipelines used to transport water for sale outside of Improvement Districts 2 and 3. monthly basis. CONTROL OF SERVICE CONNECTIONS. All service connections to facilities of the District shall be under the exclusive management and control of the District, or through its designated agent, and no user, wholesale or retail, shall have the right to operate any connections, meter, recording device or value used in conjunction therewith, Any violation of this section shall entitle the District to discontinue the delivery of water to the party violating this section. 4 The District shall be responsible for maintenance and repair of 7 service connections and meters connected directly to its lines. At the discretion of the Board, the cost of repair for damaged meters where the damage is caused by other than ordinary use, shall be borne by user. The District shall have the right of access at all reasonable times to user's premises for any purpose normally connected with the furnishing of water service. 4. APPORTIONMENT DURING TIMES OF SHORTAGE. That during times of shortage, or threatened shortage, of supply, the District will apportion available water among its wholesale and retail users in accordance with the provisions of the Municipal Water District Act of 1911, as amended, assigning priorities to domestic and other uses as may be found necessary by the Board of Directors of the District after due process. - 5. BOOSTER PUMPS. That booster pumps installed by the user must be approved by the District and set on the discharge side of the meter in a manner approved by the District; they must be operated so as to cause no strain or vibration on the District's line. for by the user.
