RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARLSBAD MUNICIPAL WATER DIS-
TRICT MAKING APPLICATION FOR THE DE-
TACHMENT OF TERRITORY FROM SAID DIS-
TRICT AND SEEKING THE APPROVAL OF
THE LOCAL AGENCY FORMATION COMMIS-
SION OF THE COUNTY OF SAN DIEGO.
WHEREAS, the Board of Directors of the Carls-
bad Municipal Water District desires to initiate proceed-
ings for the detachment from said District of the terri-
tory hereinafter described.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE
CARLSBAD MUNICIPAL WATER DISTRICT DOES HEREBY RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:
Section 1: Application and a proposal is hereby
made to the Local Agency Formation Commission of the County
of San Diego for a change of organization as follows:
A. This proposal is made pursuant to the Dis-
trict Reorganization Act of 1965 commencing with Section
56000 of the Government Code of the State of California.
B. The nature of the proposed change of orga-
nization and the names of all districts for which any such
change of organization is proposed is as follows:
1. The detachment of the hereinafter
described territory from the Carls-
bad Municipal Water District.
C. The names of all other affected counties,
cities and districts are:
1. The County of San Diego.
2. The San Diego County Water Authority.
3. The Metropolitan Water Authority.
4. The City of Oceanside.
D. The territory proposed to be detached from
the Carlsbad Municipal Water District is uninhabited. A
description of the exterior boundaries of said territory
is set forth in Exhibit "A" attached hereto and made a
part hereof.
It is desired that the proposed detachment pro-
vide for and be made subject to the following terms and
conditions:
1. The payment of all costs of said
detachment, including but not
limited to, advertising, engineer-
ing, and attorneys' fees.
E. The reasons for this proposal are as follows:
1. The territory can better be served
with water by the City of Oceanside.
Section 2: The Secretary of said District is
hereby authorized and directed to file a certified copy of
this Resolution with the Executive Officer of the Local
Agency Formation Commission of the County of San Diego,
State of California, and the Secretary of the District is
hereby authorized and directed to provide to the Local Agen-
cy Formation Commission of the County of San Diego such
information and/or maps as may be required by the Formation
Commission.
PASSED AND ADOPTED this 19th day of April, 1972.

KELLY, and MacLEOD.
NOES : None.

All that portion of Theoretical Section 34 and Rancho Agua Hedionda as shown on Map #823, Official Records, San Diego County, being more particularly described as follows: BE-
GINNING at the East Quarter corner of said Theoretical Sec- tion 34, said point' being also the West Quarter corner of Theoretical Section 35, Township 11 South, Range 4 West, re-
ferred to in the description contained within the petition for the formation of the Carlsbad Municipal Water District, dated 11/25/53;
1. thence Westerly in a straight line, to a point on the North and South centerline of the Northeast Quarter of
Theoretical Section 34, Township 11 South, Range 4
West, in said Rancho Agua Hedionda, said point being distant along said North and South centerline of the
Northeast Quarter of Theoretical Section 34 and along the North and South centerline of the Southeast Quar- ter of Theoretical Section 27, Township 11 South,
Range 4 West, in said Rancho Agua Hedionda, a distance
of 2916 feet Southerly from the Northerly line of Lot "D" as said Lot I'D" is shown on the aforesaid Map #823
said point being also the Southeasterly corner of that parcel of land conveyed to Russell Thibodo by deed re- corded in Book 1901, Page 429, of Official Records, in the office of the County Recorder of said County;
2. thence South 0°10'20" East, along the center line of the Southeast Quarter of Section 34, Township 11 South, Range 4 West, S.B.B.M., to a point which bears North
0°10'20" West, 1363.40 feet from the Northerly boun- dary line of Lot "L" of said Rancho Agua Hedionda;
3. thence South 70°39'00" East, 289.67 feet;
4. thence North 65'41'00" East 494.40 feet;
5. thence North 53'33'00" East, 240.75 feet:
6. thence North 1'32' East, 76.5 feet;
7. thence North 78'31'001' East, 186.23 feet:
8. thence South 75°29'00" East, 230.15 feet to the Easterly
9. thence North 0'06'00" West, 619.76 feet; (more or less)
line of said Section 34;
to the East Quarter corner of said Section 34 and the POINT OF BEGINNING.
